What the hell Patreon? You just screwed a lot of artists
9 years ago
Wow, just wow.
So Patreon just updated their terms of service and I think just screwed over a lot of people. Normally I don't read terms of service updates unless I find it really important. This time, however, I felt impulsed and found out that you can no longer have raffles as a reward.
Really?
I know a bunch of artists who RELY on raffles as their selling point on Patreon. What the hell are they going to do now? I honestly feel so bad for them. I don't feel good with this update seeing as I just launched a few days ago, but all those other people who have been doing this far longer...man. I just don't know what to say.
Idk, I am just really peeved right now about all this. I really hope good people aren't banned because of this raffle nonsense. Seriously, almost every artist who uses Patreon has raffles :\
Meh...
EDIT
So it has been brought to my attention that apparently this has always been a rule and I guess everyone just ignores it and does raffles anyways? So my plan right now is to do raffles until someone tells me to stop (terms of service implies I'll get a strike) Also a few of you gave me some good ideas for how to get around this by hosting raffles on other sites and stuff like that. The problem being if I get that strike I won't be able to explicitly state in my rewards that I do raffles so I'll just have to tell you guys elsewhere and people will just have to be in the know.
But yeah, thanks for the feedback and ideas :D

1$ = you like me but might not be able to afford everything else, everything is appreciated though
5$ = you get 1 (one) ticket
10$ = 5 tickets
20$ = 10 tickets
50$ = 50 tickets
100$ = 75 tickets or 1 sketch
200$ = 200 tickets or 1 colored sketch
500$ and up = why the fuck are you giving me this much money, do you have no family? no life? fine, whatever, 500 tickets and... that's it, spend your money better!
then, you host your raffle, HERE! your giving people tickets, not direct slots, they can choose to "save" their tickets and trade them in... like... 100 tickets = a quick sketch kinda thing, and ever 2-3 months you do a drawing, and... well... still a raffle e 3e damn... maybe tickets = trade in for sketches? eh? I dunno... its late... I'm tired... brain... eggs... hehe~ eggs ~ u~
On my mostly safe for work account (I posted the same journal there) someone suggested private picarto streams and maybe host raffles on there as well as do commissions/ requests.
I might have to find a way to combine these ideas :3
Also, yes, eggs~
being stuffed to the brim with eggshelping people out in "times of needs"especially when eggs are involved~~its always good to helpstuff them with eggs<3This is not new.

Raffles - especially online ones - are illegal in most of the US if any money is involved whatsoever, unless very specific gambling licenses are acquired, or your organization is certified by the state and your raffle qualifies for whatever criteria they require. Patreon is hosted in the US and has to obey US laws. Patreon specifically is in California, where even the few organizations allowed to hold raffles are required by law to give 90% of all money earned (not what the winner gets - what the person selling tickets got) to a charitable or otherwise beneficial purpose in California..
Of course, the most significant part of California raffle laws? Under absolutely no circumstance may a raffle ever be conducted using the internet, even if you are otherwise allowed to conduct a raffle.

As I just started Patreon a few days ago and just got my first news letter, which contained changes to their ToS and 90% of the artists that I know who have Patreons do raffles, I guess I kind of assumed that was one of the big changes to their ToS.
X3
But seriously, I think that's a good idea :)
I wonder if someone could just make a "suggestions box" then pull from there. Just don't say is a raffle. As long as there is no public knowledge of "winning" it could be easily argued that the artist just feels "inspired" to draw a theme. At least in the US being told you're not allowed to draw something us against the first amendment
I was thinking you could work around that by exchanging tickets for other things, not just raffles. Like, you can gain tickets over time, so 3 months of $5 tier you have $15 worth of total donations, and you can trade that in for a sketch (which normally goes for $15, so it's like a payment broken into sections) OR you can exchange 5 tickets for access to my private stream, where I'll be taking requests from the viewers. And picarto has no rules on taking requests as far as I know.
This idea is hypothetical, and when it comes down to it I'll probably just do something simple, like everyone in the $5 or higher gets invited to my streams where I might do requests and anyone who buys a commission on the higher tiers gets that.
