That's not how Copyrights work. Technically, fanart (Minus actual parody drawings, boobies/deeks on a Pokemon isn't parody, news reporting, criticism, commentary, or research) is against Copyrights and they're in their rights to flag them down. Yeah, that's bullshit, that's stupid, but legally he cannot really do anything about it

But the thing is, Nintendo is not the one flagging him. Literally every copyright claim on NSFW artists on Tumblr are just random people throwing claims around because Tumblr is, believe it or not, even worse managed than this god forsaken website.

The reporting system is ran on bots with the worst possible coding and programming. They're set to delete on report and send the copyright strike email to the original poster. It's not sent to staff and neither are staff made to review it. They've created a completely abusable system because of their own incompetence in managing a website and just plain being staff.

Not a single copyright claim I've seen on any NSFW artist's Pokemon porn have been by Nintendo or Game Freak or any affiliating companies with copyrights to Pokemon. It's just random people being terrible for who knows why.

Now if it actually was Nintendo making the claims, then that's just sorta ggs there.

A DMCA legally has to be done by the owner and not a bot or someone else. If that's really the case, then yeah he can counter the claim for that reason. I did hear a while ago how all those takedowns are from trolls and not actually Nintendo, so if that's the case, he should be completely able to counter it, and even demand the notice they got and examine it to see if it's actually from Nintendo or not

Every claim that was sent by Nintendo, when appealed, was removed. So yeah, I'm pretty sure it's not Nintendo + fair use protects the person as long as you don't sell the product.

People should really stop shielding themselves with Fair Use because it is not. Selling or not is only a factor and not the only reason to what makes something fair use or not
Like I said, if that's not from Nintendo, then he can counter it safely and easily, if not, then tough luck

It's really likely that they aren't bots, but with the way that everything gets taken down so immediately and yet an appeal response takes so long--not to mention it's just... this is Tumblr... Tumblr staff are actually well-known for being horrendous at administration and site development--it's also very possible that they just may have bots doing one of the most important jobs for a website.

I did just see something about Tumblr, how they've been flagging a lot of stuff for being explicit, even though it was perfectly fine. Happened to me once, my baby bat video got flagged and deleted 5 seconds after I uploaded it.
It may seem that Tumblr is actually responsible for all of those DMCA or they put in place something like on YouTube to facilitate false flagging. Even FA is guilty of that, some artist got banned for a week from a Kirby picture being deleted for being child porn.
Only idea I can think of is to make a new Tumblr and don't tag your uploads or use made up tags so bots won't detect you

What could You have possibly done to get Copyright infringement? Fan Art and drawing Pokémon isn't illegal last I checked. :/

There have been a lot of Pokémon artist Tumblr accounts getting flagged for copyright, many people think it's a troll, not actually Nintendo itself.
