I can see nothing but hate for the guy, and maybe he deserves it. But this seems more an extension of that than anything else, and if he never used the music in the game itself, then so what? Those files have to be something available online someplace, so it's not as if they're something you have to pay for.
If he left them in the game, then that's pretty dumb of him when he's trying to sell said game, but it could actually have just been a mistake, right?
