It was me whom filed the dispute as it has been a month without hearing from you and when i did ask you about the status, you opened the message and never responded. I do not care what your TOS says if you ignore a message about my commission I will file a dispute, that's not right. I also reported you on FA for posting my information pubically and you are not blocked on my FB, it is locked out so noone can add me that doesn't know me.

Also you can go ahead and put a beware on me, I've been activly buying art on FA for years, and have many people that can vouch for me, you haven't contacted me in a month and as in the screenshot above it shows that the message was read because it isn't bolded. You haven't been scammed, you've given me nothing so far, I wouldn't go as low to steal art from some one, so you can also take my name down because that is a breach of privacy. Thanks.

Also be a bit more professional. Next time respond to the PayPal case and not post someone's information publicly. That's asking for legal trouble.

Not to just jump on someone, but a month in art is nothing. In the past I've waited 6 months to get on a waitlist, then another 3 months to actually get the art. It's entirely possible that Blue did open your letter, then something happened and he became distracted and forgot to reply. If you only made one attempt at contact over the course of a month, that is not adequate by anyone's standards, I'm willing to bet if you'd sent another message, it would have been answered.

Hell, I've got art right now that I've been waiting about 4 months on, once a month I send a message asking for an update, and I've gotten a reply each time and some WIP screens from a couple of them, another they just have a lot in their que and will get to mine when they get there.

Also, if you've made that information public, it's already public. That's the curse of Facebook, there's no "legal trouble" to be had there.

Yea? And I've been burned by artists before, and lost quite a bit of money on nothing coming back to me and I am not letting it happen again. A Commission shouldn't take a month unless stated, I have never had a commission take a month. Also I shouldn't have to send another message it was clearly read as the screenshot depicts. And there is legal trouble because it's not public, it is private, also posting my email is a breach of privacy. Sure my name may be "publicly" online but not that email. That is a breach of privacy. Please get your stuff straight before you jump on someone.

Well in this case you're just burning yourself. One day and you freak out and try to get Paypal to refund you? I've fought people like you over Paypal before and it's very easy to simply show them a pre-existing TOS and a bit of evidence (this page of arguments is GREAT evidence btw) and they'll rule in favor of the merchant. Now you won't get art or the money.

Not all artists pump out art in a couple days, much respect to the ones that do, but my most treasured commissions have taken close to a year due to the artist's immense que, and pace of work.

Giving a mere day for a reply is selfish and foolish. You have no way to know what's going on and should give proper time for a response.

I'm going to dissect this logically::

After waiting such a short time, that's not "no word" and your message also makes no mention of implying you are worried and considering pulling your funds. You didn't handle this properly by any means.

I very frequently read messages on my phone while I'm out and about or at work, and then reply once I'm back home, which can be a good while. Sometimes life happens and you have to deal with things and something can fall through the cracks. I see several messages Blue DID respond to down further, so in all of this he's given no indication of either scam or negligence.

Blue doesn't need to mention a specific timeframe, the ASSUMED timeframe is a month and a half as stated in the TOS, and if you get it in less time, great! But whether you read a TOS or not, you are bound to it, as in all things. Blue may not be a large corporation but an existing TOS is just as binding here as it is elsewhere.

I'm not calling you a scammer, I am implying you are ill-informed and fighting a losing battle. There's a clear TOS, and what you did breaks it. What happens next is all of your own making.

It makes other artists wary to accept your commissions, an official "Artists Beware" on you will make it much harder for you to get art in the future, and the only way to resolve these is to work it out with the artist.


You've got no logical ground here, let alone legal ground. Honestly the best thing you could do is realize this and make an apology, and maybe still get your art out of this whole mess if you choose to do the right thing and cancel the dispute.

Not the artist's responsibility to tell you to read their TOS, it's your responsibility to be an informed buyer and do your homework before committing your money, and I see evidence in your own screenshot of prior proper communication on the part of Blue, barely a day to respond is silly.~ Cute trying to turn it around though.

It is not silly when the message has been read. She acknowledged it and didn't say anything so I filed a claim, which I am entitled to.

I am going to be posting a beware. As for paypal I will be dealing with the dispute now that I actually know the person who I am dealing with.

Yes, YESTERDAY you messaged me and I forgot to respond, my bad. But I never once ignored a message from you. I've messaged back each time you've messaged me except for this one time.

My TOS clearly states my TAT, and you had every chance to read it. You are breaking my terms of service, and you won't be getting a refund.

Your logic is since you've been screwed over by other artists, you're paranoid and screw over people you commission because you don't agree with there turn around time and you dint think you'll get it. It's complete nonsense.

make sure to screenshot this page, it's good evidence for Paypal. I've dealt with them before over disputes, this sort of thing turns it in your favor quickly.

I am doing so right now, and I am going to call them. Also screen shotting terms of service.

You never sent me your TOS, or had me sign anything. You made no mention of it during the exchange when we first started communicating, so it's invalid.

Each of my Commission posts say 'look at my TOS' or links my TOS, aaaaand it's on my profile to check my TOS =)

Dispute has been responded to. Even if I don't get my money back, who cares? I don't want to take money from such a personality. I'd rather deal with mindful customers.

Regardless, a beware is being posted, hopefully no one else has to go through this. This is why terms of services exist.
