Terms of Service
These are the terms of service that you accept upon contacting me (the author) with the intent of commissioning me to write a written piece of fiction.
I. My Rights and Responsibilities
1. I shall do all I can to engage with you in a good faith and professional manner while you (the commissioner) are engaging with me in the commissioning process.
2. I reserve the right to refuse any commission for any reason. Furthermore, I may also elect to refuse all commission requests from individuals or groups at my discretion for any reason. I am under no obligation to share that reason.
3. I shall retain copyright for my creative work, even if that creative work contains characters, ideas, settings, or related material that are not of my creation and that are not otherwise my intellectual property, and all characters, ideas, settings, or related materials that I create for such works. I shall retain all rights for editing and distribution of my work, including the right to use my work for advertisement, sales, as part of a professional portfolio, or other professional use related to writing or my personal professional development. I may at my discretion relinquish the copyright of my work at my sole discretion and in what manner I see fit barring applicable limitations of law. If a commissioner seeks to obtain copyright of the written work they may request a negotiated purchase of such copyright once the work is complete. I retain the right to refuse such purchases or negotiations. By commissioning me you understand that the relationship we are engaging in does not fit under the legal definition of Work For Hire and thus all relevant rules for such interactions do not apply.
4. I shall retain primary and final editorial control over all written content that I am commissioned for but will do my best to meet the expectations of the commissioner and the negotiated plan for the text. I shall do what I can to make sure the negotiated plan for the text is both acceptable to myself and the commissioner.
5. I shall negotiate and make clear to the commissioner once a request for a commission is made about any subject matters that the commissioner has requested, on a case by case basis, that I may not be comfortable writing about or at that particular moment that I have a potent disinterest in. Creation of an exhaustive list is naturally impossible but a good rule of thumb is that if my writing on a subject is likely to get me or yourself in legal jeopardy, I’m unlikely to be interested in writing a story about it. If I think a story can still be crafted without the requested subject matters then expect me to suggest alternative routes and the negotiations for the story plan can continue, otherwise I shall terminate the commissioning process immediately.
6. I will not use characters or settings without the permission of the owner of such characters and settings. If a you are seeking a gift for someone, this does mean that I will need to ask them directly for permission to include a character of theirs in the work.
7. I may require extra conditions or limitations be applied to the commissioned work. Any such conditions will be made clear and agreed to before final acceptance of a story plan.
8. In the event that the commissioning process ends prematurely for any reason, all my rights expressed in this section are retained.
9. I shall do all I can to answer questions about these Terms of Service, the commission process, or writing progress if asked.
10. I may re-order the work I take on so as to best maximize work flow. This may mean longer stories are completed later even if they were commissioned first in my present work load.
11. I shall maintain a price list for easy determination of the cost for my work.
II. Your Rights and Responsibilities
1. You shall engage with me in a good faith and professional manner while you (the commissioner) are engaging with me in the commissioning process.
2. You may repost any written work that you (the commissioner) have commissioned from me with appropriate attribution. Typically this means the use of my pen name (W.R. Frixmargen) unless otherwise specified by me.
3. You may not redistribute the commissioned work that I produced for you for the purposes of personal monetary gain nor may you misrepresent whom retains the rights to the work. Any money or financial gain obtained through the use of the commissioned work that I produce shall, while I retain the copyright of the work, be solely of my benefit.
4. You the commissioner have the right to back out of the commissioning process, terminating it, prior to the initial payment to myself.
III. Commission Process
1. You begin the commissioning process by contacting me through an appropriate channel of communication and express an interest in commissioning me for a written work of fiction.
2. We negotiate to determine a story plan that contains elements and characters that are agreeable to us both. During this negotiation you or I may suggest an appropriate length to such a story and any other necessary extra terms. I shall provide a price quote when appropriate.
3. The story length, price, story plan, and payment method will be agreed upon.
4. You, the commissioner, shall then provide full payment unless an installment plan is negotiated.
5. I will write the story, perform basic editing, and submit to you, the commissioner, the final draft for approval. If a major revision is requested, the process returns to negotiations for a story plan and any needed payment and progresses again as per the original process. If minor edits are requested, I shall do my best to make them before re-presenting the final draft.
6. If the draft is approved, any outstanding payments are immediately due.
7. I shall provide a file in a well formatted PDF file to you.
IV. Payments
1. Unless otherwise negotiated, all payments are due up front. Negotiations for alternatives are on a case by case basis and I reserve the right to reject any such requested alternative payment plans.
2. Payments methods will be decided upon during negotiations, but shall generally be done through PayPal invoice generated from my end. As I have no love for the parent company of PayPal I am very open to requests for alternative secure and reliable methods of payment.
3. Failure to provide payment in a timely manner or to attempt any underhanded activity to underpay me for my labor are sufficient for me to end the commissioning process. In the event of underhanded activity I am likely to report you, when appropriate, to any applicable authorities, or failing any such applicable authority, to make known your activity to others who may fall victim to such abuses.
4. The price scale is expressed in terms of rate per 1,000 words. Any story commissioned and completed shall be a minimum of the agreed upon length in multiples of 1,000 words, but not longer than the next 1,000 word threshold. Stories of under 1,000 words shall be the same price as a 1,000 word story.
5. Payments for major revisions negotiated after a final draft are due up front prior to the start of any further work.
V. Refunds and Cancellation
1. No refunds on completed work or works of over 5,000 words that are more than 50% complete.
2. You may cancel a commission in progress, and in doing so forfeit any processed and/or accepted payments. You shall not be provided any materials generated for the commissioned work after the moment of cancellation.
3. If I am unable to complete a commission through no fault of you the commissioner, I shall return all payment minus any transaction fee, subject to the limitations expressed in section V. 1 of this Terms of Service.
VI. Modifications
1. These terms of service may be modified at any time and may change without notice. Any commission or commission process started prior such changes shall continue as if operating under the terms of service as they existed at the accepting of the commission.
2. In the event that applicable law changes come into effect that affect these terms of service, such requirements of law shall apply actively to all commissioned work, in progress or completed, if appropriate or applicable.
