By commissioning me in any kind of way, you are agreeing to the terms of service below.
Any statement can be bound to change if discussed with me, Kuro, prior to the commission.
Terms of Service
These terms of service (ToS) apply to any work between Kuro (the artist) and you (the
customer) upon agreeing to hire the artist for the work defined (the commission).
The binding ToS is the version published as of the date of hire.
Changes to the ToS are discussable on a commission basis between the artist and the customer and
are valid only in written form.
Disclaimer: I do not own the models i use. The models i do use for the ponies are currently beta test models that are being converted from the SFM ponies to blender.
I will not share them in any way.
I : General Terms
Any commission requires a specification by the customer.
A specification consists of:
- A visual reference and/or a clear, written description of the character(s) in question
- A clear, written description of the scene requested (unless left to the artist)
I hold the right to decline any commission request or to cancel any started commission by
fully refunding the customer without the need for a reason.
Commissions are public unless requested by the customer. Public commission allow me to
publicly post work in progress versions or livestream progress on the work.
II : Payment
Payment is required fully and up front.
Payment is accepted through PayPal only and payable within 48 hours after i invoiced the
customer through their system.
Prices can be in US Dollar (USD) or Euro (EUR)
III : Scheduling
Once details are discussed and payment is received i start to work on the piece.
Either at once or by placing the work in their queue.
The work may take up to one week to complete but may be delayed due to various reasons such as,
but not limited to, queue times, personal reasons (health and family) or advanced complexity.
The customer will be notified about any scheduling changes to their work.
The customer will receive work in progress updates from me while the work is completed. The
updates are sent to the customer at various points to confirm the work is correct. The customer may
request additional updates at any time.
IV : Satisfaction
Satisfaction of the customer is a very high priority to me.
Any mistakes made by me, that were previously discussed in the specification of the work, will
be fixed free of charge.
Minor changes missed in the specifications might be fixed free of charge depending on the
complexity.
Larger changes such as but not limited to clothing and accessories, backgrounds or poses require
additional payment as the effort required comes close to a new piece or work. This also applies to
changes that developed over time and could have been mitigated during the creation of the work
(Work in progress updates)
I am not obligated to store the work, especially files required to edit the work, for an
extended period of time after the commission has been completed.
V : Copyright
I retain the copyright to the work but grants the in VI b) defined usage to the customer
while withholding the rights in VI a) to themselves.
Infringing the copyright or the granted usage rights results in VI becoming invalid and all rights falling
back to me.
Copyright infringement can be, but is not limited to:
- Removal of copyright markings / signatures by editing
- Editing the image other than cropping
(watermarking/signatures should stay visible or be moved to visible area)
- Claiming the creation of the work while not being the artist.
- Sharing files i sent you without asking for permission
VI : Usage rights
a) Usage rights of the artist
I withhold full usage rights to the work including the right to distribute the work in digital or
analog form.
I am not required to, but will attempt to, credit the customer of the work wherever possible.
I may use the work for advertisement or other kinds of commercial use.
b) Usage rights of the customer
The customer obtains the right to publish the work on any digital medium they desire with credit to
me where possible.
The customer may reproduce the image in analog forms for their own enjoyment but not for
commercial purposes.
The customer may NOT share any work files i provide.
