So, this doesn't help and for that I apologize, but from an insurance standpoint they will always place you at fault for leaving your lane if someone didn't physically hit you and push you out of the lane. It unfortunately is the industry standard because if their vehicle didn't hit yours then their insurance will not pay anything.

While that bites ass on many levels, trust me, I know, it does help protect you from the person that you unfortunately struck being able to sue you directly for damage to their vehicle once the legally at fault person's insurance denies the claim for their vehicle not being involved.

From an insurance standpoint, it is 100% in your best financial interest to be hit by someone than to avoid them and hit someone else.

However, if the officer cited the other person who actually was at fault you do have legal grounds to take up lawsuit against them for damages because their actions were criminally negligent at that point. You can also attempt to pursue the other person's insurance anyway if you manage to get their information.

Unless this was in Michigan. Then you have to file with yours anyway... because Michigan insurance laws are bullshit.

Sue them. Take them to court. If you have the police reports on your side you can sue them for not covering the damages they rightfully owe you.
