Acceptance, Compliance, and Modifications to Agreement

✯ Upon requesting a commission from the Artist, you are agreeing to adhere to all guidelines provided in this document.
Modifications to Agreement.
✯ Artist retains full right to modify this agreement at any time, without notice and for any reason. The client will be notified of these changes through a mass journal or email entry.
✯ The client is responsible to read and adhere to any alterations made to this agreement.
If asked to review our terms, the client retains full-right to cancel a commission with a partial refund

Services

✯ If the client is considered a minor, they must have parental permission to purchase a commission from the artist.
✯ The client agrees to provide accurate information for the artist to go off of.
✯ The client agrees that payment will be made based upon the T.O.S. agreement or other agreement in the payment section.

Client Rights
____________________________________
✯ The client may repost artwork to their gallery.
✯ The client may NOT sell prints of the artwork or use in any advertising matter, unless stated otherwise by the artist.
✯ If the intent of the artwork is not solely for advertising, it is not meant to be used in that fashion.
✯ The client may sell prints for NON-PROFIT events (ie. Charity Events,)
✯ The client may not sell prints of the artwork for financial or commercial gain.

Artist Rights

✯ The Artist retains the right to use the completed artwork as seen fit. This includes but is not limited to the following:
Prints for distribution
Advertising (Posting in Gallery)
Artbooks for distribution
Portfolio

WIPS/Work In Progress

✯ The client will receive 3 pictures during the art process - The sketch/line art, base color, and the final product
✯ Line Art/Flat Color Commissions will only receive 2 WIPs - Sketch and the Final Product

Payment
____________________________________
✯ The artist only accepts PayPal.
✯ Payments are required to be sent before any work in progress is sent to the client. (This can be partial or full, depending on what is discussed.)
✯ Orders must be paid in full within 3 business days, otherwise, the commission will be canceled and a 75% refund.
✯ Payments not made within three business days will result in your order being pushed to the bottom of the list. I will not punish other clients for being reliable on their payments.
✯ I do accept Payment Plans depending on the price of the artwork - Please Ask
✯ With the payment plans the client is required to pay an extra percentage for taxes.
✯ +$10 for any hold on Adopts and I will hold them up for one week or 7 days

Refunds

✯ On a canceled commission(by the client), the client may only receive a 75% refund if work has been started.
✯ After the sketch has been completed, the client may only receive a 50% refund.
✯ Once the coloring process has started it will be 25% Refund.
✯ After the artwork is fully completed, a refund will not be issued. (The client will have had plenty of time to request changes to the image.
✯ The only exception to this is within the first 72 hours if the commissioner wishes to cancel the commission they may receive a FULL refund.

Free Art & Raffles

✯ Any free art offered by the artist will be completed on the artist's free time. Not the client's.
✯ The client forfeits all rights to the artwork when he or she begins to harass the artist about it. (The artist has a full-time job - so please, bear with me.)

✯ The artist reserves the right to deny or cancel a commission at ANYTIME for any reason.

I can experiment with other things; Don’t be afraid to ask.

Payment Plans

✯ This is only for payment plans. NOT paid in full. Anything paid in full will not be charged any extra.
✯ You have the option to pay semi-monthly or bi-weekly - I will do my best to work with you

Bewares
____________________________________
✯ For any reason that the buyer does not go through with payment(1) or issues a refund after work has already been completed. The artist has the right to place a beware up on the buyer. Things that will be included in the beware are:
Username and other names the buyer is known by.
Screenshots of the entire conversation, no parts will be deleted or scratched out.
Any other important information pertaining to beware.
For any reason that the artist does not complete a commission and a refund(refer to section 8) is not issued by the artist and there is no communication from the artist after the client messages(no less than one month), the client absolutely has the right to post a beware.
Username and other names the artist is known by.
Screenshots of the entire conversation, no parts will be deleted or scratched out.
Any other important information pertaining to beware.

Art Schedule

✯ 6 PM - 12 AM (MT) ~ I will be the most active during these times
✯ I will be on at some point every single day. However, I will be the least active during the week due to my job.
✯ There are times where I may take a day off due to personal reasons whether it be spending time with family or due to stress, please respect this

Adopts
____________________________________
✯ If you want to adopt please bid under the "Bid Here" comment, if you note me wanting an adopt I will also ask that you comment under the adopt.
✯ If you win the adopt auction, I can change a few things: name, gender, slightly change color palette, a few changes in the design, and if accessories are present (horns, wings, etc) I can delete them if you do not want them
✯ If you are buying an adopt as a gift, you are required to tell me who it is so there won't be any problems with a confusion of ownership.
✯ If you claim and wish to purchase anything from me that is NSFW, you agree that you are 18+ and are of legal age to do so. Should it come to light that you are not 18+, the responsibility is not my own. You will also be blacklisted from any future purchases from me. If you AB then you are telling me you are +18, it is your job to be responsible!
✯ Once purchased, the Owner can change the name and other information, as well as make changes to the design.

Reselling Adopts

✯ You may resale the adopt for the same price or lower ~ If other art has been created of the adopt then you may resale it for more.
