ADOPTABLES
♥ Adopts are not to be resold for more than you purchased them for.
The only time they can be sold for more is if they have more art than at the time of purchase which raises their value.
♥ You must credit me and the base creator for the design whenever you upload the original adopt or art of the character the first time.
After that, you can still credit me if you like but it's not required.
AUCTIONS
♥ If you have an interest in an auction please only bid if you have the money ready to pay upfront.
♥ If you make a bid knowing you do not have the funds the item will be resold and you will be barred from bidding again.
♥ If you make a bid and for any reason need to retract your bid DO NOT HIDE IT YOURSELF, please contact me via note with the reason you need to hide the bid and I will do it for you.
♥ If you are caught hiding/retracting bids you will be warned once and the second time you will be banned. This is a zero-tolerance rule.
♥ If you constantly are bidding and then having to back out of bids you will be banned.
♥ Auctions will have a snipe guard in place, any bids made within the last 5 min of the auction will increase the bidding time by 1hr.
PAYMENT
♥ PayPal payments accepted. USD currency accepted.
♥ Full payment must be made upfront within 12 hours of an accepted order.
♥ We, the artists, will confirm the commission price with you before sending the invoice.
♥ Completion of the payment means that you agree with the cost of this service.
REVISIONS
♥ WIP's (Work in progress) will not be provided unless you make a specific request for them.
♥ If I make mistakes based on the references and directions provided, I will gladly make corrections to your artwork free of charge.
♥ Should the correction be based on new information that wasn't provided in the original inquiry, I will not be held accountable for these corrections.
DEADLINES/TIME-FRAMES
♥ I, the artist do not promise any given time frame Time restraints are at my own discretion based on when ordered, amount of work to be done, and general life permissions.
♥ Depending on project size, I can provide a promise date for completion if you have a specific deadline this must be requested prior to payment.
♥ If no deadline is set at the time of order the time frame is completely up to my discretion be this 1 day or up to a month.
REFUNDS/CANCELLATIONS
♥ If I cannot start your commission for whatever reason or you cancel it before I've started you will be refunded in full.
♥ I require two(2) - to - eight(8) weeks to process a refund, Refunds are issued in order of request.
♥ If work has been started, you will receive a partial refund based on the percentage of the artwork - completed. If the piece has been completed, no refund will be provided.
♥ In the event you do receive a refund please be aware fees are non-refundable. This includes Rush Fees, Complexity Fees, Edit Fees, etc. Fees do not get refunded just the initial amount of the order.
♥ Fees MAY be refunded per my discretion, if the issue of commission completion was of my own direct lacking then fees may be refunded. Rush fees may be refunded if they were paid and the piece was not completed in the proper time.
♥ The artwork is non-refundable once completed. This includes Adoptables.
CONFIDENTIALITY
♥ You and I both agree that we will not knowingly share any private information gained during and after the use of my services.
The exception to this is any disclosure required to complete the service.
Private information includes but is not limited to: Names, Email Addresses, Physical Addresses, Dates of Birth, or other information that could reasonably be deemed personally identifiable.
As well as account information, including but not limited to Skype, Facebook, PayPal, Bank Accounts, or otherwise.
GRANT OF RIGHTS
♥ Once the final artwork is completed, I will grant you a NON-COMMERCIAL license to: upload to your gallery(ies) and other sharing platforms with reference to the artist.
♥ In the case of adopts, you do NOT have the right to use this character or artwork for personal gain, financial opportunity, or otherwise on a commercial level. This means offering the character up for YCH'S, using them in your own personal merch, is allowed HOWEVER you may NOT sell the character to a larger company such as Hasbro, Disney, Pixar, or any other large entity for use. This includes comic brands such as Marvel, DC, and others.
♥ In the event of a refund partial or otherwise, you are giving up your rights to any works already started or any characters purchased. You may not use any of the artwork/wips unless the commission is completed in full, and the contract is filled.
♥ You agree that a charge-back or reversal of payment will constitute a breach of these terms and this grant of rights will be revoked immediately regardless of how the dispute pans out. This means any art or characters obtained you will no longer hold the rights to. If the artwork has not been completed it will be stripped and sold off as a YCH, if this was a purchase of an adopt the character will be resold.
♥ Again this is all regardless of how the dispute pans out whether you win, lose, or cancel the dispute these terms are final and unchanging.
