Regardless of the person who had them being a scammer, you did sell the character and give them the rights for Cookie.
I think it would reflect poorly to go against that.

Now ... Designing a similar but legally distinct version? That wouldn't be an issue in the slightest. Like Deadpool and Deathstroke being entirely too similar.

also you may want to update any TOS you may use for adoptables so that you can have a scammer clause. Something like voiding ownership or whatever. That way you don't break your own TOS.

I have my own opinions on this matter but I'll simply say if Solfanger wants to come forth and say something then they can. But doubt they will as it seems they ran away after being called out.

All leads have led to a dead end. If people do not like me taking back the oc then so be it.

Well considering in my TOS it says I retain the rights to my art. I wouldn't be stealing.
Legally I can use my art how I see fit. Morally it could look bad to some. Usually when selling an adopt. It's really just an unspoken honor code that an artist won't reuse/resell/take back their adopt/ocs.

But in this situation, I don't see much of an issue. Though, if that's what people wanna label me as then so be it.

I'm honestly just surprised and disappointed at how this is playing out.

Basically what people pay for is the permission to use/repost an artist's art/design. Unless otherwise discussed that the person wants to pay for the full rights.

The rights fall on me, I never sold the rights to my art/design. Legally I can do as I please. So I'll take my chances.

Again this is more of a moral/honor code thing. And honestly I'm not gonna feel bad after the shit they did.

If this is how you think Adoptables work, then you are merely leasing a design out and not actually selling an adoptable at all and you absolutely should be making your customers aware of this.

damn if that's how designs work I could take back so many characters I have sold and regretted and haven't seen art of in years XD but boy I know if I did that I would have a shit show to deal with...
though since the person in question is a scammer I am not sure if that makes it okay or not, if this is what geeki wants to do and gets back lash it is just something she will have to deal with, but id also hate to see the design die off because a scammer got run off the internet.
the other thing I could think of is if she takes it back and someone who does own the character doesn't watch her then turns up later after geeki does art and claims they own the character, then what? what happens to the character then? and the new art she does?

But Solfanger is a scammer who ran off as they didn't wanna deal with the backlash anymore.

As I am trying to find who currently owns Cookie it there is a new owner. And if there is, I won't argue. I would be happy to know Cookie is in someone else's hands.

I had a case where Solfanger told me they got her back, refunded everyone from that fiasco. Ended up saying they wanted to make her human, but still liked the monkey. I ended up co-owning the monkey side, just to get a note from someone that they were supposed to co-own her, and were wanting to pay/had paid solfanger already. :I

Nope, I didn't have to pay, they just had it as, "I know you'll put her monkey side to use." I was going to, but something told me not to. Just like I thought a year later, someone pops up. Funny enough this other person is above. XDDD I even replied up here. Serialgunner there.

I see people have an issue with this but no one has brought up the fact that all your monkey adopts look extremely similar and manage to be sold without "rights this and rights that". All in all, if you just want the core aspect of Cookie and you were gonna already update her to fix your style 5 years later, than go for it.
