Commission Terms of Service

*Tips are always appreciated, but I will never ask for them.*
Payment:
*Paypal
*Sometimes I will do commissions in return for interesting items (plush, bad dragon products, etc), please ask.
*Commissions will not be started without payment.

Commission Information:
*Must give a good digital reference.
*Traditional references are not allowed unless they come with a digital color swatch.
*Descriptions are not accepted unless color swatches and a very detailed discretion is given.
*I have the right to refuse service to anyone.
*Do not constantly request for progress updates.
*Commissions take time, as I cannot always be on the computer and drawing.
*I own full copyrights to my art. The customer will be paying for the service, not the copyrights.
Deadlines and Edits:
*For mistakes that I as an artist have made, please tell me and I will fix them ASAP. It is no problem at all.
*I cannot promise to make any edits if the mistake was shown clearly in a previous approved stage (ex. things in the sketch were missing but the commissioner didnt ask for corrections until after lining. markings were missing but the commissioner didnt ask for corrections until after shading, etc.)
*I will not redo a commission if the sketch was approved
*I have the right to charge for complex edits
*please understand that I am not the most knowledgeable in anatomy and there will be mistakes.
*Deadlines may be requested, but will be given an additional charge fee.
*If a deadline is missed, the commission will be half refunded, and the deadline fee will be refunded in full.
Customer Rights:
*The customer does not pay for the rights of the art, they pay for the service. If one would like to buy the rights to the art, please discuss this before sending payment.
*Prints or copies of any kind of any of my artworks may not be sold by anyone but myself
*The artwork is for personal use only unless discussed and agreed upon before payment is received.
*Artwork may be re-posted onto approved sites if it has been made for the commissioner, but written credit must be stated clearly where the image is posted.
-Approved Sites: Tumblr, DeviantArt, Furaffinity, Weasyl, Inkbunny, Livejournal, Twitter, Charahub, F-List, Sofurry, toyhouse, bsky, e621, discord, and Facebook. If the image is wished to be uploaded on a website not specified then you must discuss it with me.
*The customer has the right to color line art that they have bought, or have someone else color it. Resizing for use as an avatar is fine, but no further edits are allowed.
*The Customer may not, under any circumstance, edit a piece aside from what was previously stated. If it has to be fixed, ask me and I will fix it.
*None of my art may be entered in contests.
*My art may not be used as as watermarks, logos, covers (books, CDs, etc), ads, etc. without discussing it before payment is given (private use only as stated above).
*The customer may request a refund, see Refund Policy below.
*The customer may ask for updates, but please refrain from asking any more then necessary.
My Rights as an Artist:
*I may post commissioned works on any of my accounts.
*I may put any commissioned works into my art portfolio.
*I may enter commissioned works in contests and art shows.
*I may sell prints or physical items of commissioned works.
*I may cancel a commission and issue a refund. see refund policy below.
*I have the right to decline any commission before money has been exchanged.
*When a client contacts me for work, they agree that my TOS supersedes any TOS the client might have
*I have full rights to the commissioned artwork.
Progress pictures and Streaming:
*Upon request, I can show progress pictures such as Sketches, lines, and Flats. However, keep in mind that this hinders the process.
*Edits are allowed to be requests with progress shots.
*Livestreams may be requested, but will always remain private and have an added fee.
*I will not redo commissions for free unless there has been a major mistake on my part.
*Speedpaint videos may be requested, but will have an added fee.
*If a Speedpaint is requested, progress shots will no longer be allowed.
Refunds:
*A refund may be requested at any time
*If a refund has been requested but the commission has been started, a partial refund will be issued.
*I may issue a refund if I see fit for any reason.
*I do not have to give the reason if I feel it is not necessary.
*A refund for a commission has been given a deadline will include the deadline fee.
Gifting:
*I am not responsible for any drama or issues that may arise if I am commissioned to draw for someone who is not comfortable with me drawing them.
*If you have had someone commission me for a picture of your character and you are not comfortable with the image, please contact me privately to take it down.
If there is anything you may disagree with please contact me. Perhaps we can work something out, but this is not a guarantee.
Disclaimer: It is not my legal responsibility to make sure that a customer has read the Terms of Service when commissioning me. It is the customers responsibility to read the Terms of Service in full and agree to it as a whole or ask questions if they are uncomfortable or confused with some things stated. If one does not ask then I shall assume that the Terms of Service has been read in its entirety and everything stated has been agreed to. The Terms of Service is here to protect the customers as well as the artists and is completely necessary.
