Terms of Service
Posted 4 years agoThank you for choosing/purchasing my services. In doing so, you have automatically agreed to follow the conditions below. If you have any questions or concerns regarding your commission(s) or my services, please contact me at the following address: The1stPhoenixDragon@gmail.com.
General Terms-
1. Please provide a reliable or clean and neat reference of your character(s).
2. If you decide on sending a written statement of your character(s), please provide a highly detailed description.
3. You may also send pictures of animal(s) references with highlighted/marked features you wish to see in the final piece.
(For Terms 2 and 3; I will send a rough WIP/sketch to see if I’m on the right track. You may also choose options 2 and 3 to maximize the outcome of your commission. However, even with option 2, or 3, or even both, I may not get your character(s) 100% correct so please do not hold this against me.)
4. Please do not rush me. I have other responsibilities and obligations. So please, be patient with me.
5. Commissions can take from a day to a month depending on the item(s) you have selected and what you are asking me to do with the character(s) as well as the frequency of our contact. So please be aware of this.
6. If you want any changes to be made, please notify me during the WIP/sketch stage of the commission. You will be given a three day period in which to contact me. After that, I will continue with the finalizing process.
7. If the character(s) are adopts from another artist(s), please provide their contact information so I can verify.
8. I will sometimes be working on another commission before yours if their commission is smaller or they approved the WIP/sketch.
For Pin-ups and NSFW’s-
A. All characters must be of legal age (18+/20+; Depending on your country of origin)
B. Upon request, please provide legal ID (Driver’s License, Passport, etc.) to show that you are of legal age.
C. Failure to do this or downgrade your commission will result in immediate refusal.
Payment-
1. All payments are due before I start on your commission.
2. I am currently accepting currencies from Canada (CAD) and the United States (USD).
3. The prices I have set are non-negotiable. The only time my prices will change is if my skill level has improved or if I am offering a discount.
Refunds-
1. If I am unable to finish the commission, I will be willing to negotiate a refund with you based on how much progression was made on said commission.
2. If you rush/harass me about finishing your commission, I hold the right to refuse the commission/refund you.
Process-
1. You will be given a WIP/sketch of your commission to ensure we are on the right track before I proceed with completing the artwork (inking and, if you ordered it, coloring).
2. During the WIP/sketch phase, you are allowed to make up to five changes (in total) or change the character(s). After that, there will be a $5.00 fee for any additional changes.
3. Once payment has been accepted, I will begin working on the project.
4. At any time, you may ask for an update on the WIP/Sketch.
5. Once the sketch has been approved, no additional changes can be made to the piece.
Reminders-
1. If you are rude to me or harass me in anyway, I maintain the right to refuse your commission; both current and future.
2. If you decide to share the commission, please credit the artist(s). It will help them gain exposure and thus give them more opportunities for future projects, even if they have started in the field.
3. Violating copyright law includes the following:
a) Reproducing/Using the commission/material commercially (such as merchandizing).
b) Making any alterations to the artwork without the artist’s permission/consent.
c) Removing watermarks and signatures.
d) Using a commission involving a character/character(s) not belonging to you for roleplay (RP).
e) Taking credit for the artwork and/or the character(s) that don’t belong to you in the piece.
