TERMS OF SERVICE
General | Posted 10 years agoGENERAL TERMS AND CONDITIONS:
• I reserve the right to refuse, cancel, or postpone your commission for whatever reason, provided I give you written warning of cancellations or holds.
• If I feel I cannot handle the complexity of your commission or request, be prepared to be denied.
• I reserve the right to repost your image on art galleries and other websites unless you wish to remain anonymous.
• You may not use my artwork for personal financial gain, commercial products, etc without a written agreement.
• You have the right to minor revisions (up to 2 rounds before additional charges apply), but you, the commissioner, hold the responsibility of asking for revisions BEFORE the piece is completed. Additionally, unless I've made a grave error, I WILL NOT redraw a piece from scratch.
• However, if I've made a mistake on your character (e.g.: missing marking, accessory, or detail), or I have made an artistic mistake (e.g.: 6 fingers instead of 5), all revisions of this matter are free of charge.
• Do not ask for an "artistic liberty" commission unless you're willing to accept the result. I will not redraw a commission of this nature because you've disliked what I've done for you. If you have a pose or theme in mind, it is your responsibility to specify.
• You are encouraged to ask for progress on a commission, but do not harrass me several times daily for progress.
• Deadlines are acceptable, but only within reason. If you require a piece to be done by a certain date (e.g.: for a birthday), please specify in your commission request. DO NOT COMMISSION LARGE, LAST MINUTE PROJECTS WITH A DEADLINE OF 3 WEEKS OR SHORTER.
• Unless a deadline is settled upon, works in the queue will be completed in order paid. Do not make attempts to jump the queue. Any attempt at queue-jumping will result in your being barred from future commissions.
• Critique is welcome; criticism is not. Please give a helpful comment of what can be done better. Insulting, disrespecting or degrading me and my work will result in a possible cancellation of commission and refusal of future service.
• You will receive a high resolution version of your commission, with and without watermarks (if the image is digital) upon request.
• When purchasing a gift for a friend, it is your responsibility to ensure consent is given.
"REQUEST EVENT" TERMS OF SERVICE:
• First and foremost: These requests are free and out of generosity. I am not bound to a contract, so I am not obligated to complete these if I do not have the time to spare.
• Do not harrass me to complete your request. These are offered on a generosity/free time basis. Paid work takes all priority.
• I reserve the right to refuse your request for any reason.
• I will not redraw a request from scratch simply because you are displeased with the result or neglected to tell me what you wanted. To reiterate: these are free, and offered out of generosity. If you demand a redraw, be prepared to pay me for that time.
BEFORE COMMISSIONING ME:
• Have your affairs in order. Do not send a message about reserving adoptables or a commission slot without having your money ready.
• For the highest quality piece, do not rush or demand for your piece to be first or completed faster. If you have a set date that you want it by, please request a discussion about deadlines.
• Please keep in mind that I am a hobbyist, and my schedule is erratic. Delivery times will vary.
ADOPTABLES & DESIGN COMMISSIONS:
• Upon purchase completion, the adoptable is your property due to copyright law. You may alter it, resell it, trade it away, or use it in any general way that you see fit.
• I will not place a hold on an adoptable. Please make your payment within 48 hours.
• After purchase, the design is permanently yours unless you resell it (this in turn relinquishes your copyright hold).
• Adoptables are as-is. You will not recieve a refund if you randomly change your mind or you need the money back. Have your affairs in order before buying an adoptable or design.*
• If the art was drawn entirely by me, credit for the artwork used to depict the design is required. If created using a base (Halcyon, Lucid, Spookbeast etc), credit for the art must go to the base maker.
• Credit for the design isn't required, but it's very nice to do! This is underlined three times if you use the character for a commercial product.
*You may, however, approach me to see if I would be willing to purchase it back. This is optional.
DESIGN AUCTIONS:
• To prevent sniping, auctions will be extended by another 10 minutes when an offer is made within the last 2 minutes of the deadline. This is to prevent cheating, and to give ALL bidders the chance to make a purchase.
• Due to the nature of auctions, DO NOT make a bid unless you have enough money up-front to make the starting bid or the automatic buy-out ("autobuy") price.
• Do not attempt to outbid the current leader unless you have the money to do so.
• As with adoptables, there is no reserving. Payment must be made within 24 hours before the design is given to the next highest bidder.
• As with all property, the design is yours to use or resell. When reselling, you may set the purchase price or auction autobuy to the price that you initially paid for it, maximum.*
*Note that this is less so a rule and more of a courtesy.

I am a SAFE FOR WORK ARTIST exclusively. I will not take suggestive or adult commissions or requests. Do not inquire or press about this matter, you will be ignored.

• Payment method is Paypal USD ONLY. Cash in the mail, checks, or money orders are not accepted.
• Payment must be received and confirmed before work begins or you receive the adoptable.
• The commissioner may cancel the contract for any reason, no questions asked, as long as the cancellation request is done before service completion.
• If the commission is cancelled by myself or the commissioner while the work is in the sketch phase, they will be given one of two options:
A. The commissioner will recieve a full refund, and will lose all rights to the sketch. I will then have the right to resell the artwork as I see fit (e.g.: to be used as a "YCH");
OR
B. The commissioner will recieve a partial refund, and recieve the work in the state it's in.
• Once the work is complete, you will not recieve a full or partial refund, for any reason.
COPYRIGHT & OWNERSHIP:
• I retain copyright to the image. You may not trace, copy, or redistribute the image I give to you. I, and only I, can make reproductions, sell prints, use in my portfolio, or upload to off-site galleries. You may purchase the copyright for an additional price.
• You may make edits; however, if you are fixing a mistake that is my fault, I encourage you to ask me to do it for you. That's my job!
• You retain the copyright of your character. While I can alter and redistribute the specific work, I do not have access to your characters for future use or profit without your permission.
• The commissioner owns the physical object (if the commission is in physical media) and reserves the right to do what they wish with this object (e.g.: frame it; alter it; draw on it; step on it). You may do whatever you wish with your personal copy except trace, upload as your own, redistribute, or publish for personal financial gain.
• You may upload the image to your gallery, with my permission, provided that you credit the image back to me. You may also use my work for on and off-site icons, banners, and graphics with permission and due credit.
