NOT LOOSING THE HOUSE! (Still need $830)
Posted 10 years agoAs some of you know back in August of this year I went into an arrangement to Rent-to-own a house from a friend who was loosing it to delinquent taxes. I had made payment arrangements with the county to pay $600 a month to pay off the back taxes and was going to be paying Debbie $200 for the rent. So we were paying a total of $800 a month and as soon as the back taxes were paid off I was going to pay her a final agreed amount and buy the property from her.
Well that didn't happen. In September/October we received a notice of trial and were told we needed to pay the full taxes of almost 6k. Her taxes went back to 2008. We went and spoke with the attorney and judge that was handling the case and offered to pay the county the $800 for 6-7 months to pay off the taxes. They were happy to agree to these terms. This cut Debbie out of the agreement completely and she personally didn't care. I have the title for the house and the lot already signed over to me. It is a matter of being unable to file them until the back taxes are full paid off.
For the last 3 months with our checks and the help of
who has been amazing we have been able to make the payments as agreed at the end of each month. I have the receipts and proof of payment as well as the charges to my bank card. Its been hard with Jon having lost his job and trying to find a new one, one not paying anything for a few months and then a baby was born a bit early. @.@ We have managed it so far.
As of 11/30/2015 I was super excited about how low the final payments had gotten. Keep in mind that the 2015 taxes had come out and that was an additional $1300 added to the previously owed balance. The balance was sitting at $913.90 for the lot and 3331.03 for the house. Added together it equals a total of $4244.93. At first that bummed me out cause I thought we had paid much more than that. Looking back at the paper i realized that the taxes due were now only from 2012-2115 verses all the way back from 2008. So if you subtract the approximate $1300 for this years taxes that means back taxes wise we had paid down to $2944.93 for the house and lot. Which made me even happier. So all we have to pay is the remaining 3.5 yeas of taxes since 2012 is half paid off already. So I was happy with the progress on this and everything had slowly started falling into place. Matt was finally making money to pay his portions, Jon got a full time jb and is enjoying it and the Dia started working full time as well so then he can make his full payments. That means everything is covered and settled so we could finally get caught up on things.
So far we have been making our payment of $800 a month at the end of the month around the 30th. Only because it makes it easier on the house hold due to when check and payments fall. The agreement with the county was we had to make $800 payments a month between 30 days of each other and that is what we have done. We haven't missed one yet thanks to
if we were a bit short he really helped us out.
About a week ago I received a foreclosure notice due to delinquent taxes so I immediately called the count clerk the next morning when they were open. Of course I was partially in panic mode due to the notice since we had been doing everything according to the agreement. When I called them I spoke to the office and the District clerk Gangie told me not to worry about it due to it having been an automated letter that went out to anyone who had delinquent taxes. I told her I wanted to make sure because i didn't want anything to go wrong. She reassured me twice everything was fine cause she saw the payments being made and that it was just an automatic message.
Welp.. No... Apparently not...
On Friday I received a Notice of Trial once again on the delinquent taxes. I called to speak to Judy Lee, who I needed to get a hold of about the account. I spoke to a gentleman named Daniel. Daniel looked at the account and was surprised and actually asked me if the $800 was the agreement and I said yes. Apparently it is higher than he was used to seeing. He looked and saw the payments to my account and asked a few questions. Judy lee, the paralegal has notated my account as of the 15th of December as. 'failure to adhere to payment agreement.' so they are taking us back to court. I've been making my payments I have the proof, but that may not matter in the case once more. They only agreed that first time because we said we would pay them the $800 instead of Debbie getting the $200. Yet that SAME bitch, yes... she is a bitch -_- I hate dealing with her, of a paralegal is now saying that we are not adhering to our agreement and taking us back to court... If we go back to court they could easily ask us to pay everything off in 3 months... Which there is no way in hell I would be able to do... that would be $1958.31 a month... There is no way we can pay that much and still be able to float...
With this that means I will now have to pay $1600 in court costs as well as a major chance of me loosing the house if they decide not to deal with this anymore.

So today I noticed that my dad had called yesterday while I was out picking up our roommate so after some phone fail attempts... My house phone was on crack and i have 3 witnesses to it. I got a hold of him.
Dad asked me about the what all was going. I told him about the christmas, current house situation the works and he asked me where the taxes were sitting at. I told him what was going on and he asked if i had proof i was making the payments. I told him yes, I have all the proof I need for it i even had gotten them printed out today and that i just made a payment. I gave him the DB links for the proof that I had been paying to show him.
He asked me about the total amount needed and i told him and he was like. "Thats all?" I was like yup, but that we were afraid that the county would take the house before we could do anything cause we don't have rights to it. He brought up his concerns on what happens if we paid it off and they still took it. I explained to him that I already have all the legal papers to get the property in my name. The house and lot have been signed over to me so once the back taxes have been paid i only have to pay the filing fee and viola house is mine. He said that was great as long as it got to that point.
I brought up that i wish i could take out a 5k loan and just get it it taken care of and done with. He mentioned that it was below 5k though and i told him i figured that would give me a good cushion to fees and other things that might pop up with that. He asked where the taxes were at and i explained to him that it was originally back from 2008/09 to now. We also have gotten down to only 2013-current. I gave him all the numbers and he was surprised we had already paid it down that much. He asked about the court notice and likes. So I explained it, and the following happened.
Me : I don't know what i would do if they wanted to take it for the taxes right now and they are going to add another $830 for the court cost if they don't waive it.
Him : Then you pay it off.
Me : I don't have that kind of money. (I was thinking he was talking about the $830 case we had been previously talking about the court cost and how stupid it was to make me go back and possible harassment.)
Him : Then you see if they take card then and there and call me i'll pay it.
Me : The court costs?
Him : All of it
Me : All.... of it.. Like.. Taxes too?
Him : Yes, then I can lower your payback price from the 800 down to paying me back at 600-650 a month. We can discuss it after i get numbers.
So he asked how much everything taxes wise it would be to play it off with like a credit card cause places like that have fees. So tomorrow I am calling the tax office and seeing how much it will be and he is going to pay it off as long as they can take it or see if he needs to send cashiers check.. ;;
I don't know if he is also going to cover the $830 court cost and $175 fee as well or if we have to... but I'm seriously in tears right now.
