By requesting a commission you’re agreeing to the following points:
- Every and all pieces created by the author (such as illustrations, designs, animations, animatics, logos, etc.) are to be considered pertinent to these Terms of Service.
- Each and all commissions must be paid fully (100%) at the time of submission (otherwise, no slots will be reserved), and be accompanied by its pertinent reference sheet (or the best image of them you can provide) in the case of characters, mascot’s photo in good resolution, landscapes, etc. In the case of not being able to pay fully, at least 50% of the total will be asked for beforehand, and this will require the rest to be fully paid before the final delivery of the piece. The author has the right not to deliver a piece of which the payment is still pending.
- If the client can’t wait (or doesn’t want to wait) until their turn in the queue, the total amount to pay will be raised by 50% for each piece they request under such conditions.
- It’s a requirement to deliver a clean reference sheet in good resolution (no +18 reference sheets will be accepted, in case of having one, it will have to be censored beforehand even if with a splat of color done with a cellphone’s image editor or whatever program the user considers convenient).
- No fetishes of any kind will be allowed, commissions with +18 and/or controversial themes will not be taken, up to and including (except for some non-explicit exceptions):
o No vore.
o No feet.
o No mawshots.
o No pedophilia
o No TF.
o Etc.
- The author has the right not to accept a commission whatever may be the motives (such as the themes being considered +18, controversial, fetishistic, or against the author’s own political or religious beliefs).
- It’s a requirement for the client to have a clear and solid idea of what they want at the moment of submitting the commission (or at the time of it being processed once their turn in the queue arrives). The client has the right to make three adjustments according to the initial idea during the sketch phase of the work. Once finished they have the right for two free adjustments (not considering a complete overhaul of the piece). After this there will be extra fees for each adjustment to the drawing based on the original price. Depending on the degree of partial or total modification of the work, and the type and level of detail required, a new price for the work will be given.
- The drawing starts being property of the person that paid for the commission once delivered, it can be re-utilized in any social networks or media, in whatever or whichever form they may deem convenient, except re-selling the drawing or profiting with it in in undue ways (for example: re-coloring it and profiting with the re-colored version), unless the client pays for the transfer of rights, in the case of a design they want to commercialize in the future).
- In the case of asking for the transfer of rights to commercialize with the piece in the future, it will be agreed by both parts through a contract under the 17.336th law of Chilean Intellectual Property, in which they will assess if the piece can be modified partially or fully by the contract. In case of requiring a contract before a notary and the DDI (Chilean Department of Intellectual Property), the client will have to pay, besides the previously agreed extra percentage, for the online procedure.
(The price for the transfer of rights depends on the total price of the piece).
- In case of there being delays due to pending works in the queue or slots taken, an estimated waiting time will be given after the commission is submitted. Both the client and the illustrator will have to respect the time established.
o The artist may, however, take some additional time or extend the deadline if he deems there’s a valid reason to do so (e.g. health problems will be considered a valid reason).
- Once the commission has been paid and the sketch phase of the job is done, there will be no refunds. If the client regrets the decision, there will be no refunds since it implies a loss of effort and time by the artist.
- To avoid conflicts with payments (such as possible scams or unintended chargebacks), a receipt will be either via PayPal or through the Chilean Intern Taxes System (SII). Otherwise a registry will be recorded through screenshots.
- Once the piece has been finished, it will be delivered in HD either through Sta.sh or directly to the client’s desired e-mail address. Permission will be asked to upload the piece to the artists’ social networks.
- If the client doesn’t respect the Terms of Service, modifies the piece without the artist’s written consent, improperly profits from it, harms, threatens or injures the artist in any way, they will be put automatically on a blacklist with the right to appeal accordingly.

Al momento de pedir una comisión usted estará aceptando los siguientes puntos:
- Se consideran dentro de los términos y condiciones todos los tipos de obras creadas por el autor, desde ilustraciones, diseños, animaciones, animatic, logotipos, etc.
- Toda comisión debe ser pagada en su totalidad (100%) al momento de ser pedida (de lo contrario no se guardará slot), con su debida referencia en el caso del personaje (o bien la mejor imagen que tengan), foto de mascota en buena resolución, paisaje, etc. En caso de poder pagar un porcentaje menor, se pedirá al menos el 50% del total de la obra, la cual al momento de entrega del trabajo final se requerirá el pago total del pedido. El autor tiene derecho a no entregar una obra que tenga el pago pendiente.
- En caso de que el cliente no quiera o no pueda esperar su turno para el trabajo, se deberá pagar un 50% más del valor total del diseño o ilustración.
- Será requisito entregar una referencia limpia y con buena resolución (no se aceptarán referencias +18), en caso de tener una así, será obligatorio censurarla aunque fuese con una mancha de color en el editor de imágenes del teléfono o en cualquier programa que el usuario estime conveniente).
- Fetiches de cualquier tipo, comisiones +18 y temáticas polémicas no serán tomados. En esto se considera (salvo algunas excepciones no explícitas):
- No vore.
- No pies.
- No mawshot.
- No pedofilia.
- No TF.
- Etc.
- El autor está en todo su derecho de no aceptar una comisión sean cuales sean los motivos (se consideran fetiches, temáticas que no vayan con las creencias políticas, religiosas o cualquiera sean las causales).
- Será requisito tener una idea clara y sólida de lo que quiere al momento de pedir la comisión (o bien cuando sea requerido al momento de llegar su turno para iniciar el trabajo). El cliente tiene derecho a tres correcciones en base a la idea inicial en la fase de bocetaje. Ya terminado tiene derecho a dos correcciones gratis (en la cual tampoco se considerará un cambio completo de la obra). Luego de esto se deberá pagar un porcentaje extra por cada corrección en el dibujo, dependiendo de la modificación parcial o total de la comisión, se dará un precio de acuerdo al tipo y nivel de detalle del pedido.
- El dibujo pasa a ser propiedad de la persona que pagó la comisión, puede ser utilizada en cualquier red social, de la forma que él o ella estime conveniente, excepto re-vender el dibujo y lucrar de manera indebida (ejemplo: re-colorearlo y sacar ganancias de este a menos de que el cliente pague derechos de cesión, en el caso de un diseño que quiera comercializar a futuro).
- En caso de pedir derechos de cesión para comercializar la obra a futuro, deberá quedar acordado por ambas partes mediante un contrato y bajo la ley Nº17.336 de Propiedad Intelectual chilena en el cual se evaluará si la obra puede ser modificada total o parcialmente según el contrato. En caso de requerir un contrato ante notario y el DDI (Departamento de Derechos Intelectuales de Chile), deberá pagar, además del porcentaje anteriormente acordado, por el trámite que se realiza en línea.
(El precio por derechos de cesión depende del precio de la obra creada).
- Al momento de pedir la comisión se dará un tiempo estimado, en caso de que haya ya slots ocupados, el ilustrador y el cliente deben respetar los tiempos acordados. (Se considera motivo de atraso válido en las comisiones la salud del ilustrador).
- Una vez pagada la comisión y ya avanzada en la fase de bocetaje no hay devolución del dinero, si el cliente se arrepiente no hay vuelta atrás ya que es trabajo y tiempo perdido por parte del ilustrador.
- Para evitar conflictos con pagos, posibles estafas, se dará una boleta como comprobante ya sea en Paypal o a través del Servicio de Impuestos Internos (SII) o se dejará registro a través de capturas de pantalla. Los precios en pesos chilenos están en valor bruto, por lo tanto si pide boleta a través del SII deberá pagar un 10% más (por ejemplo si la comisión sale $5.000, con boleta serán $5.500).
- Si bien los precios están en dólares, cuando algún cliente chileno quiera comprar puede hacer uso de Cuenta RUT o Mach y se hará la conversión del precio del dólar del día en que se pidió la comisión.
- El comprador al momento de recibir la comisión, se le entregará en HD ya sea a su correo o a través de Sta.sh. Se pedirá el debido permiso para subirlo a redes sociales.
- Si el cliente no cumple ni respeta los términos y condiciones, modifica la obra sin permiso, lucra sin permiso del autor, daña, amenaza o crea injurias, pasará automáticamente a una lista negra con derecho a apelación según sea la falta.
