Mass Effect 3... and giving away some xbl gold!
Posted 13 years agoFeel free to discuss it but NO SPOILERS PLEASE!
I am loving this game so far. While there are some things about 2 that I miss, and some that I wish were different ( ;_; ) ME3 has me. It's also really cool that the multiplayer affects the single player campaign!
My 360 copy of the game came with two free days of Gold and I have no use for it so I may give the code away to someone who wants it.

Regarding begging/donation journals...
Posted 13 years agoIf you see someone asking for donations, especially when they claim that it's medical-related, for your own sake it is best to treat it with a healthy dose of skepticism. Exceptions of course being if you know the person IRL and are aware of their problems or if their medical troubles are backed by a legitimate fundraiser.
I've been seeing one journal in particular being publicized recently and this person has claimed to have had various health-related troubles for several years and has account-hopped frequently during this period. Be careful of where you choose to donate your money because not everyone is sincere and there are a bad few out there who wish to take advantage of this community's trusting and generous nature.

Anyone going to Elliott's Spring Gathering?
Posted 13 years agoI really, really want to try and make it this year. Heard good things about it and the hotel seems awesome.
Edit: out of respect for someone who now has to live with the consequences for the rest of their life, please do not bring up the very recent drama. Gossip about it in any of the undoubtedly countless related journals or via notes, but not here. Thank you.

Art, copyrights, and you.
Posted 13 years agoI often see a lot of misinformation on these subjects floating around, so I made this journal to hopefully be helpful to those of you out there who may not be so sure of your rights. And of course, if anything I've said here is factually faulty, I welcome correction.
1: The artist owns the art.
Upon creation, artwork is automatically copyrighted to its creator whether digital or traditional. It doesn't matter if you commissioned it or if it depicts your character, Unless you have specifically negotiated to purchase the copyright, it does not belong to you.
What this means: The artist is legally entitled to display it where they wish, sell prints of it or other commercial uses, and you do not (again, unless the copyright was purchased from them). Often, an artist will allow you to repost the commission to your gallery but that is a courtesy and not a right. The artwork's owner can file a DMCA to get the art taken down if it is posted somewhere against their wishes.
In the case of a commission for traditional art, even if your character is depicted, the artist has the right to sell the original if your transaction did not include receiving the physical piece.
2: Characters cannot be copyrighted in the same way that art is.
Yes you heard me. Copyright law doesn't exist to protect ideas, it exists to protect the expression of that idea (i.e. art, see #1 or in the case of when they're a part of something bigger like stories, which should also be copyrighted to be covered by this.)
Characters can be trademarked, but this process requires them to have a distinctive enough likeness that sets them apart from other characters, and for them to be used commercially. Once trademarked, in order to keep it you would have to show willing to legally defend this trademark. This is why companies like Disney are very defensive of their characters' likenesses, even to the point of making daycare centres remove murals.
What this means: Legal action cannot be taken against someone 'stealing' your fursona. While unethical, non-trademarked characters are not protected by law except in instances where representations of them (like artwork, again see #1) are protected.
3: Artwork commissions are not "work for hire".
I've seen people try to refute point #1 by claiming that commissioning an artist is work for hire. This is incorrect. Work for hire requires that the person be considered your employee, and a freelance artist is not. It also still requires a contract giving you the rights to the work!
What this means: Commissions are a contract between two independent parties, not an employee-employer relationship. This argument is entirely wrong.
4: "Right of first sale".
While the copyright remains with the creator still (see #1), if you purchase a physical representation of art like a print, traditional drawing or painting; just like with any object (eg a book) you have ownership of that object and have the right to re-sell it. Generally, it is seen as good etiquette to offer the original artist a percentage if selling it for a profit, or to give them the opportunity to buy it back, but you are not legally obligated to do either of those things.
What this means: You can sell the object that you own, but cannot make copies and sell those, or distribute it in other ways such as scanning and sharing it online as those violate the original copyright.

Join me and the other Artist_Beware mods on livestream!
Posted 13 years agoRight now on http://www.livestream.com/artists_beware
To quote Kerstin's post about it:
We are going to see if we can come up with a generalized flow chart to help with the dilemma of "I'm having a rough time with this artist, but I'm not sure if I should post about them yet. What should I do?"
Myself and a couple other moderators will be boring entertaining you on Skype, and we'll be watching the Stream chat, so up to 50 people can join us and make suggestions in real-time.
DISCLAIMER: As this is occurring outside of the actual community, mods will not necessarily be in official mod mode. While the image on the screen (the flow chart) will be G-rated, the voice and text chat may stray into higher ratings. ;)
So yeah, come join us and listen to us dick about if you were ever curious what I sound like!

Holiday wishlist meme thing
Posted 14 years agoI've seen a few people do this and so I thought I'd have a go! It seems like such an awesome idea and I love the karma aspect of it. xD I'll be looking around to see if there's any of these I can fulfill for someone ^^
Step 1
Make a post in your journal containing your list of 10 holiday wishes. The wishes can be anything at all, from simple to really big. The important thing is, make sure these wishes are things you really, truly want.
If you wish for real-life things, make sure you include some sort of contact info in your post, whether it's your address or just your email address where folks could get in touch with you.
Step 2
Surf around other lists to see who has posted their list. If you see a wish you can grant, and it's in your heart to do so, make someone's wish come true. Sometimes someone's trash is another's treasure, and if you have a leather jacket you don't want or a gift certificate you won't use--or even know where you could get someone's dream for free--do it. You needn't spend money on these wishes unless you want to. The point isn't to put people out, it's to provide everyone a chance to be someone else's holiday elf--to spread the joy. Gifts can be made anonymously or not--it's your call. There are no rules with this project, no guarantees, and no strings attached. Just...wish, and it might come true. Give, and you might receive. And you'll have the joy of knowing you made someone's holiday special
Step 3
The List
1. Art of any of my characters would be absolutely thrilling! Especially icons. I'm totally on an icon binge right now >_> If anyone was so inclined, references for my doods can be found in my gallery here or my account for commissions and gifts
tesseract
2. Music recommendations! I've been introduced to some amazing stuff this year that is either normally outside my usual (classic rock, 80's, OSTs of games I like, some electronica etc) or bands that I'd forgotten about/didn't realize they were still going... so yeah. xD
3. Booooks! I want the MTG novels like burning, and books 2 & 3 of the Night Angel Trilogy. I love me some fantasy stuff like The Elenium (need to get The Tamuli!) I also adore crime fiction and thrillers. Sidney Sheldon was my favourite author for a long time.
4. Money. >_>
5. Riot Points for League of Legends.
6. Purple things. Give me ALL of them. It's my favourite colour and looking at it makes me happy. Silly, I know. =p
7. An XBL gold sub. Mine ran out. *sadface*
8. To improve as an artist. I broke my hand this year for the second time and spent months unable to hold a pen or stylus without considerable pain. As a result I've really stagnated and hate everything I draw. If you've wondered why I haven't submitted any of my own lineart for a long time, that's why. I only slightly less hate my colouring.
9. I'd like for people to learn how to agree to disagree especially on harmless subjects. It's perfectly fine to state your perspective on things, but if you do so then be aware that there are others who are equally entitled to express theirs. Instead of going on and on about it until the dead horse has been pulped or trying to bully them until they concede, walk away. Some differences just can't be bridged and that's okay as long as we can all accept them.
10. For everyone to have an awesome holiday season and best wishes for 2012. It feels like a lot of things have been in a hole for a long time. The economy is a big part of that and here's hoping we can all recover from this shitty period.

When people abuse your kindness...
Posted 14 years agoMy husband and I have two roommates, one of which lost his job and hasn't contributed to rent since September. Hubby won't kick him out (or he'd be gone already, trust me) because the guy is his 'friend' but it's reached the point where we can't afford to support him any more.
He's living here and to make matters worse he eats our food due to crying about being poor - despite getting foodstamps - uses our stuff and sits on his ass playing videogames, watching tv or getting stoned for hours instead of getting a job, is apparently incapable of locking doors or turning lights off when he leaves a room, and now he got us slapped with extra on our cable bill from ordering a bunch of on demand movies. I don't know about you, but if you're living in someone else's house for free the least you could do is not contribute to their expenses, right? Talk about taking fucking liberties. We are barely able to make ends meet right now.
Anyway, I posted this not just to vent, but to thank the people who heard about this before when I posted it on LJ and have been really helpful.
Thank you
DebonariDragon for your generosity,
taasla for being wonderful,
kayla-la
synviver and
kerstinorion for the advice and empathy, and
coffinberry for the page plug.
I'd also like to thank all my watchers, friends, and the other awesome people I've gotten to know through this place. You're the reason I'm here.

Taking colouring commissions to help Luckypan
Posted 14 years agoAs I'm sure most of you have heard,
luckypan is raising funds to get a kidney transplant. See her journal here: http://www.furaffinity.net/journal/2898361/
I will be taking commissions to colour lineart and the proceeds will go to this fundraiser. Everything I receive will go to her.
Prices: $5 per character for flat colours. Shading will have to be negotiated.
If anyone else is doing something to help, let me know and I'll pimp it here.

Colouring requests reopened
Posted 14 years agoMy hand seems to be getting better so I'm going to reopen colouring some lines that people provide for me! Bear in mind that I can't accept all of them, I will pick and choose, and these are for practice so don't do expecting anything too amazing =p It's up to me whether they will be flat colours or fully shaded.
You must of course have permission from the artist if you didn't draw the lines, and these are for colours only not inks.
edit: I'm not a mindreader, so please provide colour references too.
If I colour your piece and you like it, or you're just feeling generous I'd appreciate a donation or a tip. The paypal to send it to is xbladez[at]hotmail.com

Posted 14 years agoI want to thank everyone for all their recent condolences, for the happy birthday wishes, to
faint and
spearfrost in particular for the amazing art that has really been uplifting, and to everyone for all their support. For every fave, watch, or comment I've ever received. I appreciate every single one and overall this community has been wonderful to me.
You guys are amazing, and I wish I could give you all some cake and hookers or something.
It's hard to believe I'm 28 now. I don't really feel it at all. Let's party and put bad times behind us!

Posted 14 years agoI was told just a few days ago that my father was killed in a motorcycle accident. It's 4 days 'til my birthday, and my husband leaves to go out in the field on my birthday.
Dear October, please stop hating me.

Hey what's up! =D
Posted 14 years agoHi guys! Just another update and stuff from yours truly!
It's my birthday in two weeks, I'll be 28 and my husband won't be around since he's going to be in the field so I probably won't be able to celebrate much.
Also, I was one of the people chosen to be a new mod for the LJ community Artists_Beware, which I'm thrilled about, so that's something positive!
What's going on with you guys?

If you can help
Posted 14 years agoNot for myself, but
coffinberry could really do with some assistance. Commission her or donate if you can please. She's been completely fucked over and is at risk of being evicted, through no fault of her own. http://www.furaffinity.net/journal/2714387/
I've done what I can to help and it would be really appreciated if you could too.

I've done what I can to help and it would be really appreciated if you could too.
I've been gone a while, I know.
Posted 14 years agoI want to say thanks so much to those who left shouts on my pages and noted me to see how I was doing, and I'd like to thank those who watched me recently as well even though I wasn't uploading anything. To be honest, since I broke my hand (for the second time) a coupla months ago it has been very painful for me to hold a stylus. The outer edge of my right hand aches constantly from the base of my pinkie finger all the way down to my wrist and it's intensified by trying to draw or write. Maybe I've got a trapped nerve or something, idk.
I'm still trying to work on art but it's a slow process due to this. I'm not dead!
ps: Anyone play League of Legends? Some friends got me into it a little while ago.

Absence
Posted 14 years agoI've been gone for a while and since not everybody knows, just thought I'd toss up a general update. I've been very sick for the past couple of months, and recently reinjured my (dominant) hand that I originally fractured last year as well. Typing is fine since it's my pinkie metacarpal that is busted and I can manage with just my index and middle fingers on that hand. Expect art once I'm all healed up! @_@
Gears of War 3 beta code giveaway!!!
Posted 14 years agoI have ONE code for this final week of the Gears 3 beta to give to someone. If you're interested post here and I'll pick one lucky person if nobody on my facebook calls dibs on it haha. Also I have a friend who's got one left too so you never know!
I hope everyone had a good Mothers day and stuff. I've actually been sick for a couple of weeks now and starting to get over it so expect to see more work from me soon!
