TERMS OF SERVICE
*By commissioning me you agree that you have read through this document and accept all terms of service below.*
I. General Terms
- I, as the artist, reserve the right to deny commission work for any reason. I may choose to disclose that reason.
- Any ill behavior, discrimination, or hate will not be accepted and will result in your commission being cancelled.
- You must be an adult to order a pornographic commission from me. If you have ordered a pornographic commission claiming to be an adult and I am informed afterwards that you are a minor this will result in your commission immediately being cancelled and you will be banned from my services.
- Periods longer than two weeks (14 days) in which contact cannot be made with the client will result in the contract getting cancelled for the time being.
II. Payment
- All payments are done through Paypal or CashApp (CashApp preferred).
- Once an image concept and the price is agreed upon by both client and artist an invoice will be made by the artist and will be sent based to the client including the pricing breakdown for the work.
- Payment is given once the line-work of the commission has been completed and the coloring would begin (For any commissions that are just line-work, this simply means payment before delivery).
- Payment will be requested by the artist by sending an updated invoice with any additions or changes made to the invoice. The client and artist will agree upon a payment platform and the payment will be sent by the client to the artist.
- Upon receiving that payment I will deliver the line-work of the commission. In the case of any commission that is only line-art, as stated above, this would just be delivery of the finished work. If the commission includes coloring I will continue the completion of the work. Colored pieces will be delivered upon completion.
III. Process
- Work-In-Progress (W.I.P.) updates may be provided for all commissions over $30. This is provided as a discussion point for the artist and client to suggest any changes, however, I am not obligated to act upon any suggestions made when showing a W.I.P. A client may request a W.I.P. for a commission above $30 by reaching out to me.
- I have the right to deny a request to send a WIP in the conditions of high frequency of requests from the client.
- Commissions generally take about one to two months to complete depending on various factors (health, order of commission, complexity, work, or family issues). General completion time increases depending on the amount of characters requested and the type of piece requested. If the piece feels like it is going to take longer than two months I will do my best to update the client. I will also inform the client of anything that affects delivery time as soon as possible.
- Redraw requests will be accepted at the discretion of me, the artist, and may carry an additional fee based on the amount of work that must be redone. The client will be informed of the additional charge before the redraw is confirmed and acted upon.
- Clear reference and detailed description of your illustration is a great way to avoid additional redraw fees. Without provided reference or description you agree to my discretion as the artist to depict the commission as I best see fit.
IV. Copyright
- I take every copyright to the produced artwork as the artist. I have the right to display the art on/in anywhere to my liking, make printable goods, promote myself with, or post with.
- I do not take any rights of intellectual property displayed in the arts, such as characters, designs of outfit/background/props that didn't originate from me.
- The commissioner may not take credit for the completed work or any W.I.P.s sent during the commission period. “Pan Red” must be accredited every time the client wishes to post or display the completed commission.
- In personal use, buyers get partial rights on finished artwork such as posting, displaying with credit, and use in profile/header images only on personal (non-business) accounts with credit given as denoted above.
- If used in streaming, buyers get rights of personal usage on promotional content and page contents given aforementioned written credits are provided. Direct use of my art for profit such as merch is prohibited - in this use case, purchase of commercial rights must be bought.
- Commercial rights cost 500% of the original commission price for the work. This will give the buyer the right to alter the work to their liking before displaying it, remove the artists watermark, and use it commercially. If commercial rights are purchased, credit must still be given to “Pan Red” for the original artwork in any uses and when attributing credit to works featuring any versions of it.
- You are not welcome to use my art for artificial intelligence training data or any other form of machine learning tool. If you do, you will be banned from my services.
- All of the following will be considered copyright infringement and will result in revocation of buyer rights on artwork as well as the right to report the behavior publicly: Reproducing the artwork commercially in any way without purchasing commercial rights, posting/displaying the art in any way without credit to the artist, claiming the art in any way as your own, removing watermarks/signatures without written permission from the artist or buying commercial rights, and altering the artwork without the artist’s consent or commercial rights. If I find you stealing my work, I will do everything in my power to take it down.
V. Cancel/Refund
- I reserve the right as the artist to cancel the commission at any point without disclosing why. Any payments that were made may be refunded.
- A client may request that their commission be cancelled and may request a refund if they have made payments. I am not obligated to refund a client, although I am far more likely to respect cancel/refund requests made earlier rather than later.
- Once payment is received and the final artwork is delivered, the client may not request a refund for any reason.
- If a charge back is filed against me, all rights to the current commission work as well as any prior works as the buyer are retracted and you will be banned from my service forever. Your name will be publicly displayed for other artists to watch out for. I have the right to file a complaint and you agree that I have full rights to all money paid to me during the time you were using my services.
