Im also a terrible writer, so uhh, theres that too.
Would you agree to these terms? Are some things too harsh or unnecessary? Is there a way to make this smaller, easier to read. Its kinda a wall of text atm.

This is a journal to state the terms of which i would be willing to accept a commission, what i will agree to do, and what i won't do. This IS subject to change, but any changes will be timestamped as to not allow me to shoehorn in new rules after accepting a commission. This is likely NOT legally binding, however i expect anyone i commission to be kind enough to tell me if they have any issues with this agreement, and decline, or negotiate on the terms.

Contact:
- You SHOULD keep in good contact barring act of god, and keep myself informed of anything that might break contact and/or delay the commission.
- I will contact you of my own will if i think contact has been broken and ask for an update given a reasonable amount of time passed (might be weeks, or months depending on promised delivery date/type of commission), the purpose of contact is not to rush or pressure you, rather, maintain good communication and understanding of the situation.
- Myself contacting you should never be the sole grounds for blocking me, banning me from commissions, harassing me, taking my money without producing content or otherwise badmouthing me.
Distribution:
- I will post the artwork to my FA giving full credit to everyone involved, i may also post said artwork to E621 given it is not shown as disallowed in your TOS
- You should credit myself, and everyone involved in all posts of an image i order. This includes other people in a couples commission, given i have provided an account for you to refer to. Crediting the other people involved is MUCH appreciated, though, i wont pester or harass you to do it, that is on them.
- A small watermark referring to my character (eg: Kara owned by Trippledot@FA) in the image is most appreciated, somewhere discreet on the image to not ruin the quality of the artwork itself.
- You are of course, allowed to post the image to any of your accounts or websites, given it is not being used to defame, insult, harass me or be an attempt of stealing my character.
- I will ask politely of you to remove the image if it is hurtful or you use it in a way negative towards me, and expect you to comply without complaint and in a timely fashion; as prolonged exposure only makes the situation worse. Failure to do so and moderation will have to be contacted.
Refunds:
- I reserve the right to request a refund given no contact is received over a prolonged time, and after my own attempts of contact have failed. Or if the quality of art delivered is nothing like that given in the examples or in your gallery and you are unwilling to remedy the case.
- The refund requested will be in an amount reflecting how much work has been done, based on your pricing sheet. I may expect a full refund given a grievous error on your part that you could have easily avoided.
Usage:
- Any use of artwork containing my character(s) should be treated with respect. No badmouthing, no shaming, or anything alike.
- You may not use artwork containing my character(s) for profit without specific consent. Advertisements for your craft without consent is okay; Selling artwork of my character(s) in a book, mugs, prints etc are not.

Artwork rights
Posted 8 years agoIve been seeing a lot of artists recently slipping in commercial rights to their artwork in their TOS and its making me fairly uncomfortable to be honest. I would be horrified if my character(s) were used for merchandise without my knowledge/permission. I do understand that an artist wouldnt want ME using their art commercially, i get that, but why do they have the right to use my character? And i get nothing out of that? Do i get a discount off the commission, do i get my commission paid off if they make enough sales etc etc? Do i even get the courtesy of being asked before its done?
Yknow, for a community that abhors theft of IP, characters, copying/tracing etc... stuff like this being allowed surprises me.
Im going to have to start being way, way more careful about who i commission, and what im agreeing to. Artists are slowly stripping away all rights from the consumer.

You get into art because you LOVE art, Yet so many of you never seem to do art for yourselves these days, Only commission work.
Set up a schedule, Maybe do three days commission work, and have a day aside to do art for yourself.
Nobody should blame you for doing something other than commission work, And you shouldn't feel bad about it either.

im getting sick of forgetting who artists are or having to unwatch/rewatch artists and be spammed with "im oving submissions" and journals
That said, don't make it a system where people get unlimited name changes, maybe one every six months, if people could do it willy nilly id never know who is who D:

Telegram voice and Privacy
Posted 8 years agoTelegram has just started rolling out calling as a feature. And for those that dont know, it will be using a neural network AI to adjust behind the scenes settings to improve call quality. To do this, it will of course have to collect user data, nothing personal of course.
I personally, think its really cool, but i know a lot of people care about privacy... What are your thoughts?

They are, one of the very few artists, of which i have commissioned, that has taken the time to notify me when they are taking longer than expected on a commission, and keep me up to date along the process.
I would highly recommend anyone interested to check out this artist.

Regarding WIPs
Posted 8 years agoIve noticed some artists that absolutely refuse to give WIPs, or just don't give them out per standard for whatever reason.
I think it is of EVERYONES best interest to give out WIPs. I think it should be a standard thing.
It lets the customer know the piece is being worked on, for one. It would hopefully stop any unnecessary "nagging" from the customer. Just as a quick example, there have been a few commissions where ive messaged the artist asking how things are going (after a few weeks of waiting) and they mention they have already started work on the piece. If a WIP was given at any time since they started, that would keep one happy customer.
Its insurance for both parties. at the bare minimum, a sketch WIP ensures that everything has been communicated properly. Talking ideas over text is really shitty, what may be a clear and concise idea in one persons head might mean something else to another. As an addendum, typos and mistakes happen, sometimes the wrong ref's get provided, or the artist mixes up poses. A WIP opens up a window to prevent a severely dissatisfied customer, or a fight/argument over charge-backs, refunds or redoing a piece.
It also greatly avoids embaressment to the customer. Some customers, take their characters very personally, and if a mistake is made and it puts the character into an undesired position, or scene, it can be very emotional, and hurtful... and if the piece is just posted straight up, without any checking with the customer, the moment its posted someone has saved it, and that image is forever on the internet, even if taken down from the artists page.
Maybe some artists are insulted and think they aren't trusted when a customer wants a WIP but i ensure you that is entirely the wrong way to look at the situation. You could be the most trustworthy artist in the world and still misunderstand something, or make a simple mistake, or maybe the customer isn't the best at describing things either.
If it is a matter of the extra time, and effort that goes into sending out a WIP... im positive a majority customers do not mind at all. It could disrupt an artists workflow to start work on a piece, send out a WIP... then wait for the customers response, but i believe that is well worth to avoid all that can happen if it is not done, and for the most part an artist can move on to the next customers piece while waiting for a response.
PS: This little rant is mostly aimed at longer, bigger commissions. Things like sketches, chibis, YCHs are not always worth a WIP.
PPS: This journal is not aimed at any artists in particular, or intended to insult or call out anyone. It is just discussion on the commissioning scene and how we may improve it. If you, as an artist have your reasons for not providing WIPs, thats fine, and i respect that, feel free to discuss it.

Use of my image
Posted 8 years agoIts become time when i have to make this clear. After having more than a few little instances where someone has used my images on another website, say as an avatar, or reference image for roleplaying or even just sharing to a forum.
I will start off by saying... it is okay to use my images, as long as respect is paid to myself and the artists involved.
I expect a few simple things;
A link to my page (somewhere visible and relevant, not in tiny text hidden somewhere)
No misleading or uncharacteristic edits to the image (best to ask first to be safe)
Acting behaved while using my images (I don't want to be attributed to troll-like, hostile behaviour or oddball kinks)
Not using my images just to harass or defame me or anyone else.
If any one of these is not respected, then i will have to ask you (or the moderation of the website if you don't respond) to fix it, or have the work taken down.
Additionally, just because i say its okay doesn't mean you have permission from the artist too, every artist has a different policy and you use my images at your own risk. I would recommend seeking out the artist(s) TOS and check out their posting and usage policies. I will most likely NOT ask you to take artwork down for the sake of the artist, but what the artist does and wants is beyond my control and i will respect.

A few times recently ive only noticed an artist finished a commission once i saw it in submissions, the artist didn't send a shout, or a note, or anything.
I don't always check every single submission that comes in to my inbox... heck, i won't always be watching every artist that i commission from.
Do let your customer know you've finished the work, please.
