Copyright, Trademarks, Fanart, and how it applies to artists
General | Posted 14 years agoI've seen, over many years, scouring the net, a lot of confusion, and misrepresentation as to exactly how, and what is protected, in what ways, concerning copyright, as well as confusion over trademark infringement, and the ways in which this applies to us, as artists.
Copyright law was written in 1909, then rewritten in 1976. The original iteration was written such that any work that was created -had- to be copyrighted to be protected, and renewed every 28 years.
With the US's joining of the Berne Convention in 1989 (an international collective, committed to overall protection of created works), copyright law was amended from the original text of the Copyright Act of 1976 (which took effect in 1978), removing the requirement to register a work to be protected, requirement to include the copyright information visually, and also pretty much eliminating the need to renew a registration (a work is protected for 50 years after the creator's death).
In 1996 the World Intellectual Property Organization Copyright Treaty (WIPO) was introduced. It's an expansion of basic copyright to the member countries, to try and move the stagnating laws into the digital age. Through it, things like computer programs are protected as literary works, and much, much more.
In 1998, along with a lot of law juggling, the Digital Millenium Copyright Act was passed (DMCA) along with the Sonny Bono Copyright Extension Act (which increased the protected term by 20 years [so, now 70 years after death of creator, a work is protected]).
Now, to the meat of it:
Copyright protection exists to protect the creator of a work (be it literary, auditory, visual, or a combination of these) from theft of the work, or potentially damaging (monetarily/statutorily) works. It allows the creator to seek legal action on infringing organizations or individuals.
Under copyright law, the moment your work exists in a tangible form (thanks to WIPO, even intellectual property is treated as tangible), it is protected. You also have certain basic rights that are yours and yours alone as the copyright holder. These are, the right to copy, distribute, sell/rent/lease, and create derivative works based upon the original work (in the case of audio/visual works, also the right to perform/display it publicly).

What does this mean about fanart? Is my MLP/Sonic porn protected?
Well, first, we need to define a few things.
Fanart:
As touchy as this subject is, here's how it equates out.
Fanart is a derivative work.
"Well, what's a derivative work?"
I hear the question now.
Here's how Copyright Law defines it:
A “derivative work” is a work based upon one or more preexisting works, such as a translation, musical arrangement, dramatization, fictionalization, motion picture version, sound recording, art reproduction, abridgment, condensation, or any other form in which a work may be recast, transformed, or adapted. A work consisting of editorial revisions, annotations, elaborations, or other modifications, which, as a whole, represent an original work of authorship, is a “derivative work”.
You are using copyrighted characters in your own depiction. As stated above, only the copyright holder has the right to create derivative works, unless this permission is given, in writing, to someone else.
"But I made this art myself! I own the copyright to that at least!"
Not quite.
Title 17, United States Code, Section 103a states this
The subject matter of copyright as specified by section 102 includes compilations and derivative works, but protection for a work employing preexisting material in which copyright subsists does not extend to any part of the work in which such material has been used unlawfully.
And here's the referenced Section 102:
(a) Copyright protection subsists, in accordance with this title, in original works of authorship fixed in any tangible medium of expression, now known or later developed, from which they can be perceived, reproduced, or otherwise communicated, either directly or with the aid of a machine or device. Works of authorship include the following categories:
(1) literary works;
(2) musical works, including any accompanying words;
(3) dramatic works, including any accompanying music;
(4) pantomimes and choreographic works;
(5) pictorial, graphic, and sculptural works;
(6) motion pictures and other audiovisual works;
(7) sound recordings; and
(8) architectural works.
(b) In no case does copyright protection for an original work of authorship extend to any idea, procedure, process, system, method of operation, concept, principle, or discovery, regardless of the form in which it is described, explained, illustrated, or embodied in such work.
"That's all legal jargon. What's it really say?"
Firstly, Section 102 subsections a,b is saying that the listed works are protected under copyright, but, that protection does not extend to ideas, procedures, methods, concepts, etc, that are presented in the work itself. (i.e., you cannot copyright the way you made a piece, the idea presented in it [unless it is an idea relevant to a literary work, which is another ballgame all together], or a concept that hasn't, itself, already been copyrighted on its own as part of a larger work.
*edit/update* To better clarify the above, it means you can copyright a character, a setting, but not a pose, drawing style, or specific arrangement of words.
Now, on to Section 103 subsection a.
This says that all compilation or derived works are included in what's covered above, except when any portion of the work is produced unlawfully (i.e., without permission).
What this means now, is that you've forfeited all of your rights to a copyright claim.
"So...who holds the copyright to my art?"
This is where copyright law gets weird.
The answer is, no one.
The original copyright holder can't claim it, as they did not create it (and therefore cannot sell, copy, or redistribute it in any way).
Having unlawfully created this work, you've forfeited your own copyright on the work itself, and therefore cannot do any of the above either.
Section 106A does grant some rights to visual works production, regardless of 106 itself.
These are: For the author of the visual work to claim authorship of the work itself (i.e., you can say you drew it)
If someone mutilates, distorts, or any modification that is prejudicial to the honor of the author's name, they can prevent the use of their name on the work.
The only rights you (and the original holder) have is to stop others from copying it (that means you can -still- legally track down the art thief who is reposting your MLP/Shrek porn, and take legal action against them, however, tread with caution here, as this is a very dangerous train, since the original holder can also seek legal action against you).
So, tl;dr version, fanart is copyright infringement, and is illegal.
"But it's a parody! It's fair use!"
Not quite. Now, back in 2002, US Courts upheld that a work cannot simply be stricken down outright because it -might or might not be- fair use. All fair use claims are handled on a case-by-case basis.
"What does that mean?"
You don't decide if what you're doing is Fair Use. The courts do.
Thus far, my favorite misrepresentation of all of this is "The government doesn't enforce copyright law. It's the copyright holder who has to file a claim. So, if no claim is filed, you're in the green."
I can jaywalk any time I want, and the cops around here won't ticket me. It's still illegal, even if it's not being enforced. Non-enforcement does not equal legal.
Now, on the subject of fanart. How about fan created characters.
This is a fun area, because you start to slip from Copyright into Trademark, and this is where the difference between the two really shows forth.
Trademarks are registered elements, that, in a specific application, are tied to a good or manufacturer.
Examples. The Nike "swoosh", The McDonald's golden arches.
Character examples: Batman (not Batman, as in Bruce Wayne, but the application of elements. His insignia, the yellow tool belt, his pointed cowl and cape), Superman (his insignia, the blue outfit with red cape, his spitcurl).
These elements, when combined, can be trademarked, as they are representative of a "good" which is created and sold to the public.
Knowing the difference between copyright and trademark, here, is important. You cannot copyright any single one of these elements, but they can be registered, collectively, as representative of something larger.
The most interesting trademark I've seen is owned by Wiffle Co. (they make wiffle bats and balls).
The bat itself bears this marking on it: "The color YELLOW is a registered trademark of Wiffle Co."
It's actually legal, but it can be confusing.
The color yellow, in the application of plastic bats, is trademarked to Wiffle Co. Therefore, no other manufacturer can make yellow, plastic bats, without infringing on Wiffle's trademark.
Make sense?
Here's how it applies to fan characters.
You cannot simply change a name, or one characteristic of a character from a novel, movie, or comic, and claim it as "original work". You run a high risk of infringing on copyright and/or even trademark.
This was upheld not too long ago with a literary sequel to "The Catcher in the Rye". A man wrote a book, and legal action was sought against him, specifically for his main character, named Mr. C. (This applies more to fanfiction, but is still applicable). The infringement claim was that Mr. C -was- Holden Caulfield (the original character from Salinger's book). Even though it was never stated, the similarities were too hard to miss. Despite claims that his fanfic was "Fair Use" the novel was killed, and author wound up having to pay out to Salinger over copyright infringement.
Characters like Batman, Superman, Harry Potter, and Holden Caulfield here, are subject to copyright. However, generic characters are not. One cannot copyright "thug 3" just because he found his way into Batman, or Superman. To avoid infringement, you have to really push yourself outside the basic elements of a character to truly create something new.
I could create a guy named Supreme Commander, and dress him in Blue, with a big bullseye on his chest, and a red cape, and a spitcurl. I may not be infringing on Superman's copyright, but I am treading hard into trademark infringement (the blue suit and red cape, and the spitcurl), and can still be sued over it, unless I press hard into parody territory.
TL;DR version. Changing names or small things like hair/eye color does not make it original, and you are still, likely in copyright infringement and even trademark infringement.
My favorite area here. People complain about the whole "profit" thing, and compare selling a used video game.
The law even covers this one folks. Check it out. (Important, in regards to people who sell prints).
Section 109 states that, in regards to a particular copy of a work, the owner may sell, or dispose of possession of that particular copy, without the authority of the copyright holder.
This means that if someone buys one of your prints, they can sell that print to someone else, if they so choose (but they cannot copy it, nor can they sell copies of it, this applies only to that specific purchased copy).
Lastly, misrepresentation of the © symbol.
The proper format for the symbol is thus:
© <year in which the work was completed/first published> <name of copyright holder>
i.e.
© 2011 Marshall K. Wood
Things like "© me" don't work. It's actually an improper representation of the format.
Also "© verias" doesn't work, -unless- it's in full format, and the work -is registered- to myself, and in the pseudonym section (the forms for copyright have this) I put "verias" as my pseudonym.
Then I can put "© 2011 verias" on there.

MFM 2010 Con Report
General | Posted 15 years agoNow that I've had a bit of sleep from my return home, I can type up my little report of how MFM 14 went for me.
Before I do though, a couple of things. I have a habit of being more of a socialite at conventions, and don't do much to make it to panels (usually I just get caught up talking with new people I miss out on the panel times).
So, here's my day by day rundown of what I saw, who was there that I noted or spoke with, and the overall experience for those who don't know much about this convention.
Friday:
Got a late start heading out, but got to the con around 1:30 in the afternoon, which didn't hamper things too much.
I did some meandering around, things feeling almost kind of empty at first, but what it was, was that the hotel grounds are so much larger than the previous hotel, there was more than enough room for everything, and still room to mingle.
The first person I actually ran into was, *gasp*, MaxBlackRabbit, who was, amusingly enough, hiding out in the very back of a somewhat quiet Artist's Alley. Anyone who gets apprehensive about finding face time with this gentleman should breathe easy. He's very approachable, pleasant and polite. He's also rather clever at his attention grabbing. He had 3 ref books in front of him on the table, a PSP playing Queen's Blade, Spiral Chaos, opening, facing out, and beside it a Nintendo DS, with a game I wasn't able to identify. So, even at first glance if you don't know who MBR is in person, the shiny lights of technology jumped at you.
I made my way by his table several times through the weekend, mostly just creating small talk, but not wanting to distract him too heavily from his weekend workload.
I made a nose path through the Dealer's Den next, which was well laid out, easy to navigate, where I ran into Seppel, and learned a good bit about Furoticon, and had a few good laughs. Right around the corner from there was Bussaca, Bonk, J3T, then just past the back "U" of the path between tables, we had Patches Namaki, and quite a few others.
Now, MFM is what I'd call a smaller, calmer convention, not necessarily boring, but definitely a more sublime and relaxing environment for the most part. Everyone is sociable and fairly easy to get along with. I brought my mate with me this year, and this was her first furry con. She was rather apprehensive at first, but she found that this con, especially, is good as a "starter" con for anyone unfamiliar with furry antics in person.
After my perusal of the grounds, I finally ran into the first person I was looking for. Baka Sukonku. Baka is one of those furries that I think everyone knows. I went around con, asking complete strangers "Have you seen Baka yet?" and without fail, -everyone- knew who I was talking about. Finally I found the fruity skunk out at the smoking area, and we shared a hilarious bearhug, and I was introduced to a few others who were new to me, Crim, Tuya, and Synth.
We decided that food sounded good, and set off on a little walk to the strip right down from the hotel. (For those not familiar with the Whispering Woods grounds, there's a small strip mall within easy walking distance, so no crazy wandering for foods.) This food trek turned quite hilarious as we couldn't actually decide what we wanted to eat. There was a buffet, a chinese restaurant, a sushi bar, a smoothie bar, and a McDonald's. We started to go for sushi, but found we'd missed their lunch service by about five minutes. So we settled on chinese. The place is called China Taste, I think, and it was amazing food. No buffet here folks. It was sit down, food made to order, and it was great. Once we headed back, we all split up to wander once again. Through the rest of my evening, I did managed to meet back up with KP Fox Paw, Brim, Khyle and Dook (The amazing twins, one dances, the other draws). Khyle is amazing with poi, and he's a wealth of knowledge on the topic. Now, anyone who does know the twins will be sad to know they cut their hair. They are still hilarious though. I have arts from Dook I shall have to post later... Moving on.
The glory of con, in my opinion is the badge hunt. Every time you meet someone new, you end up badge hunting to see if you know who they are in the online world. I had a hilarious moment of this when I went to the bar for happy hour. I was sitting, drinking a Samuel Adams, and there was a gentleman two seats down from me drinking quietly. We were all rather quiet, just sitting and enjoying our drinks, and somehow this gentleman and I wound up in a conversation. I don't recall who sparked it, but we were talking about software and tablets and such. About midway through, I realized I was unsure who I was speaking with, so I asked who he was, and apologized for the "bird head" ducking to see if I could locate his badge. Turns out, this pleasant bar patron was Jay Naylor (Fisk). I summarily rose, shook the man's hand and offered respect to his art. Then we continued our conversation until his mate and roommate arrived to collect and shepherd him off elsewhere. Once again, he was quite pleasant to speak with, easily approachable. Word of note, I do believe this was due to Jay being "off duty" as he was not busy working or trying to focus on something. We did cross paths again later in the weekend, but he had the appearance of a man on a mission, so it was a simple, quick greeting exchanged. He was actually looking for Bonk at the time, who had abandoned his post somewhat. Anywho, Friday evening, we engaged in the pizza feed. It was fun, delicious and I ran into Kos and his mate once again. It's amazing how many people I remember who have forgotten me. I chock this up to the 3 year gap between con trips and my vast change of appearance. Kos was his hilarious, lewd, and inappropriate self. And anyone who hasn't see him and his mate in their "Cats" attire is sorely missing out. To which, I also must add, after they got into suit and makeup, we met back up with them and Kos paid me the most hilarious non-compliment. He looks at me and says "You're loud and obnoxious. Why don't you dress up?" We all shared quite a fun laugh at that. The night wrapped up with a dance in the main ball room, where we got to see Khyle showing off some excellent poi, and also giving some pointers to a few other furs. We wrapped up our evening outside where Drumming Raccoon was playing his selection of tribal drums and another fur, whose name sadly escapes me now, was playing guitar. I do have some footage from this that I will be uploading to Youtube soonish.
Saturday:
Once again, I got a late start, arriving from overflow back to the convention center at around 11:30ish. I popped into the Dealer's Den and pestered Blackfrost on and off, which was fun. Those of you who haven't met her or seen her arts, go look nao!
blackfrost Moving along. I met up with two Arkanfurs, which is a change, last time I made it to MFM (in 2007) I met plenty of Texas and Oklafurs, but none really from my home state. I met Klyde S. Dale, and Klaatu Wolf, both amazing guys, bikers, and generally good company. I spent a bit of time talking with the two of them which lead to discussions about the SCA and cosmetic effects makeup. The rest of the early day was somewhat uneventful aside from one hilarious visual exchange between Dook and I. The story starts thusly. We traded sketchbooks, and he said he needed to hop off for a minute, I said that was fine, I needed to head off too. So, off he goes, and me about 20 feet behind him, to which we meet up again in the men's lavatory. He makes the obligatory "We've got to stop meeting like this." whilst we do our business. Somewhere between finishing up and exiting, we wind up on the meme "My eyes! The goggles! They do nothing!" and as I'm zipping up I turn, and Dook is standing at the door with his vibrolight/laser thing, zapping me. Behind him, the door to the lavatory suddenly opens, to which we are given a rather quizzical look of "What the hell did I just walk in on?" This story was much fun to relay later to unsuspecting furres. Around the wrap up of the evening I was stalked down by Spectrum, whom was referred to me after a discussion about Paint Tool Sai and digital artwork. I proceeded to do a "30 minute hallway panel" with my tablet pc, showing her some of the tips and trick I've learned through the years, and showing how I personally integrate Photoshop and Sai together in my artwork, as well as some shortcuts for flatting that I've found through some 3rd party PS plugins. From there I was invited to a Bro-Pa-Looza at her room later in the eve, and was then told I had to meet Brody, who is apparently staff for RCFM (Rocket City Fur Meet). The BPL was quite fun, and meeting Brody was interesting, as a welcome side-effect of meeting the RCFM staffer, I also was introduced, officially, to XianJaguar, with whom I sat (stood) and spoke with for a short bit. She's another one of those easily approachable, provided you know your manners (I think). We talked a bit of shop, and I felt honored I could share a few of my shortcuts with her that she's willing to go and experiment with. We returned to the BPL, had some more drinks, and headed out for a smoke. The bartender met us later, and as we started to head back, we were informed the party had become pants-optional. My poor mate was somewhat appalled to see neon green skivvys upon our re-entry to the party and huddled quite close until we headed out again.
Sunday:
Day Final, we got up early, checked out of the hotel and headed to the convention center. Met up with Baka, Kiba, Dae, Victus, and some others, to which we were introduced to their newest scheme, Drag/Trash King and Queen. Beefy Curtains, Sandy Snatch and Kunt Punt. It was amusing to hear their descriptions of their drag fursonas and I was able to offer some good fun add-ons, and now Dae has decided it is her project to make beer bottlecap spurs for her shoes. I got Dook his sketchbook back, and went and dropped some money on J3T and Bussaca for commission pieces (Bussaca's piece is in my gallery, I will be scanning J3T's soonish). So, most of the day was spent, checking back and forth with various peoples, pestering Patches, Blackfrost, Dook, and MBR. I picked up 3 furoticon decks, herm, boys and otherkin, and mostly had a good time seeing everyone one last time before the drive back home. Of course, the last thing I was told, by I'm not sure how many Souther-furs was that I must make my way to RCFM next year to do a panel. After collecting the final things from people, we grabbed some McD's and were on our way.
Summary, for those who all TL;DR:
MFM is a much quieter con, compared to things like AC and MFF, but it's a very welcoming atomosphere. You never know who will show up (MaxBlackRabbit, Jay Naylor, etc). I met K'sharra, Duo, Strider Orion, and Beowulf Kennedy at a previous MFM, just to note. I also believe, honestly the biggest compliment I get, living in the realm of near anonymity in the fandom, is when someone asks who I am, sees my badge and goes "I know of you". So, keep that in mind, you never know who is watching or who might know who you are, so it pays to be respectful. I don't fanboy/girl over the "heavies" but I think that's more my nature, which does make it easier to strike up a conversation with them. I'm sure they get plenty of "OMGWTFBBQSQUEELITS MAX/FISK!" *insert furfamous of choice*. So, word of advice, keep it calm, talk to them like people, because, they really are people, just like us, and that'll also tell you pretty quick if their fame has gone to their head.
I, likewise, plan to make it to MFM again next year, and will have things to sell at that point (a 150 page graphic novel, amongst other stuff).

The Last Airbender (Some fun facts people missed)
General | Posted 15 years agoThis movie was bad. I mean, really bad. But, despite everyone's rush to blame M. Night, I must point out a few other things that make it less his fault, but he's still not blameless.
The primary areas the movie suffers is assumption, pacing, MPAA (the rating game), and length. Before you stare aghast at this, let me explain.
Firstly, assumption:
The movie assumes that the viewer is already familiar with the characters and situation, therefore inelegantly steps around any real development of our protagonists, and primary antagonists. It glazes past the things that make us typically care about the characters, because it assumes we already do. It's painful to watch, seeing each step of the movie jump us 10 miles, instead of moving alongside the characters and growing with them.
Second, Pacing:
This is partly to blame on the aforementioned, but not entirely. The pacing is rushed, to pretty much sum up the entirety of the first book in a 90 minute movie. Important details are overlooked, and the pinnacle of any adventure movie is really lost here. The -journey- is the most important part of the adventure, seeing what it takes to get from point A to point B. At best, the movie comes off as a cluttered montage. A rapid-fire series of events to progress us to Aang accepting his role as the Avatar.
Third, MPAA, or, the rating game:
This is the hardest thing to really quantify aside from how much had to be dumbed down to keep a PG rating. It's a stretch that M. Night hasn't made in a long time. He's never done an adaptation, much less had to keep to a stringent rating, in order to try and include a broad spectrum audience. Zuko's scar is less garish and smaller, the act of actually making the Fire Nation appear as evil as they are is left to the wayside in order to allow an all ages audience. Had he been able to aim for a higher rating, he could've shown the genocide of the Air Bending tribes, and had Zuko looking fittingly disfigured. He could have had Aang become legitimately angry and shown some of the backlash of that, that was in the series in the first book. It could have made more of the movie stand paramount, instead of this rapid-fire execution of porridge.
Lastly, Length:
This one is the part that kills me the most. 90 minute features are becoming fewer and farther between. The movie could have been a bit better had they taken an extra 30 minutes through the movie as a whole, and brought us into tune with the characters. Giving us a more properly established backdrop and setup, instead of having Katara narrate over the gaps of progress to move story along. I would have happily sat through a 2 hour long, well established film, than sacrificing a half hour just to make things a bit quicker. Once again, I am going to blame this on the broad-spectrum audience. Standard first showing is around 6:30-7pm, and the movie is being released right before school starts back up...therefore, a 2 hour movie is pushing it for a lot of the younger viewers, and would cut into box office sales. An hour and a half? More "nominal and normal" for a moviegoing parent who takes their kids along.
Now, the final thing I'm going to toss in here is about the writing. It wasn't poorly written, so much as it was poorly adapted. This is not entirely M. Night's doing, either. Michael Dante DiMartino and Bryan Konietzko are billed as Executive producers. These two gentlemen are the creators of Avatar: The Last Airbender. When they pitched this to M. Night, he knew nothing of the series. His kids and he got the DVDs and watched them. He fell in love with the story and was eager to commit to doing the trilogy. Downside is, he wanted to honor the source material as much as possible. It was Bryan and Michael who he came to, to find out what to keep, and what to remove. To him, it was all important, it shaped the world and characters. They, the creators, worked hand in hand with him on the adaptation. So, if anyone is responsible for fucking this up, they hold equal, if not more blame for destroying their own creation.
That's my 2.5 cents on the flick. Feel free to add your own!

The primary areas the movie suffers is assumption, pacing, MPAA (the rating game), and length. Before you stare aghast at this, let me explain.
Firstly, assumption:
The movie assumes that the viewer is already familiar with the characters and situation, therefore inelegantly steps around any real development of our protagonists, and primary antagonists. It glazes past the things that make us typically care about the characters, because it assumes we already do. It's painful to watch, seeing each step of the movie jump us 10 miles, instead of moving alongside the characters and growing with them.
Second, Pacing:
This is partly to blame on the aforementioned, but not entirely. The pacing is rushed, to pretty much sum up the entirety of the first book in a 90 minute movie. Important details are overlooked, and the pinnacle of any adventure movie is really lost here. The -journey- is the most important part of the adventure, seeing what it takes to get from point A to point B. At best, the movie comes off as a cluttered montage. A rapid-fire series of events to progress us to Aang accepting his role as the Avatar.
Third, MPAA, or, the rating game:
This is the hardest thing to really quantify aside from how much had to be dumbed down to keep a PG rating. It's a stretch that M. Night hasn't made in a long time. He's never done an adaptation, much less had to keep to a stringent rating, in order to try and include a broad spectrum audience. Zuko's scar is less garish and smaller, the act of actually making the Fire Nation appear as evil as they are is left to the wayside in order to allow an all ages audience. Had he been able to aim for a higher rating, he could've shown the genocide of the Air Bending tribes, and had Zuko looking fittingly disfigured. He could have had Aang become legitimately angry and shown some of the backlash of that, that was in the series in the first book. It could have made more of the movie stand paramount, instead of this rapid-fire execution of porridge.

It's a very well written movie, in the sense that it leaves you thinking.
Not only that, once you watch it, let it settle, then you should watch it a second time. The nuances are very strong and well placed.
Even for non-religious types, the movie is a very involving experience, with an amazing ending. Gary Oldman and Denzel Washington both shine very well in their roles as protagonist and antagonist, inversely.
I found the film very enjoyable, and something that I feel has the depth, if people are willing to accept it as it is, to outshine some of the shinier films of late.
My 2 cents.

Both suitable for adults and children, it's an epic tale with stunning visuals, and original characters.

I thought on this a bit, and I realize, sometimes the urge to give into it is pretty strong.
Then I thought even more, and decided, being recognized for drawing that stuff leads to only drawing more of that...instead of focusing on what I really want to draw.
Mentally, I equate it to a form of selling out. Leaning toward the consensus to gain popularity or attention. If I want to get recognized, I want it to be for my creations and my artistic style, not because I drew Link or Neytiri, or Krystal...
Does that mean I won't draw these characters?
No, but it does mean I won't make a big deal out of it if I do.
My goal is to improve and find people who admire my art for what it is, not to pander to the masses in order to gain acceptance.

This has definitely taken a huge edge off of things and a load off of my shoulders, at least until things pick up a bit more. Commission half off will continue until further notice.

Artist In Need of Assistance!
General | Posted 16 years agoI know it's not standard form to "pimp" myself out in this manner, but it's a rather serious time. I'm fighting just to keep my head above water.
As some of you may or may not know, around 2 weeks ago, I joined the ranks of the unemployed. Truth be told, I was taught, hard-headedly, growing up, to be self sufficient, and it comes as a challenge to ever ask for help, even when I need it. Now, don't take this the wrong way, I'm not scraping and begging for donations and hand outs. In the wake of this, there is some good news. I was accepted as penciler for a comicbook called Blackwood, by KnightShift Entertainment. The downside, is that it will be a bit before it pays off. In the meantime, to simply pay my bills (since I just got into this place on my own) for this month, I have to acquire something to the tune of about 600 dollars. No easy feat, especially for being unemployed.
So, here's the real deal. No one likes to give something and get nothing, so this is how I'm rectifying that. I'm knocking my commission prices down by half until further notice. That's right, everything half off, rounded down to the nearest dollar (i.e., $10 becomes $5, $35 becomes $17). Now, the harder part of this, is being a fairly unknown artist, so, even if you aren't interested in purchasing a piece of art, spread the word. This money is and will be going to keeping the essentials (car, electricity, rent). Now, don't take this the wrong way, I'm not scraping and begging for donations and hand outs. In the wake of this, there is some good news. I was accepted as penciler for a comicbook called Blackwood, by KnightShift Entertainment. The downside, is that it will be a bit before it pays off. In the meantime, to simply pay my bills (since I just got into this place on my own) for this month, I have to acquire something to the tune of about 600 dollars. No easy feat, especially for being unemployed.
So, here's the real deal. No one likes to give something and get nothing, so this is how I'm rectifying that. I'm knocking my commission prices down by half until further notice. That's right, everything half off, rounded down to the nearest dollar (i.e., $10 becomes $5, $35 becomes $17). Now, the harder part of this, is being a fairly unknown artist, so, even if you aren't interested in purchasing a piece of art, spread the word. This money is and will be going to keeping the essentials (car, electricity, rent). This is my first real endeavor into actual comic work, and it's going to be keeping me pretty damn busy, but hey, it's a foot in the door. The comic looks to be lots of fun and violence. It's a supernatural horror story about the world existing just beneath the surface of our every day life.
I plan to have fun with it, and hopefully, meet all my deadlines on time.
These guys have been awesome since I submitted, and incredibly supportive of my own ideas and views on some things.
It may not be much, but it's a foot in the door.
