When commissioning me you are agreeing to my Terms Of Service. As the client, you are responsible for reading this section, upon payment you are confirming that you have read and agree to all terms below.
════════════ Payment & Refunds ════════════
• The method of payment is PayPal, I use PayPal invoices.
After the client has discussed their commission, after agreement from both parties, the client is required to provide a Paypal email for the invoice. All payments are due upfront unless otherwise discussed, and are only accepted through PayPal and in USD. Artwork will not begin before payment. After the invoice has successfully been paid, the process can begin.I send the invoices, please do not send payment via friends and family on PayPal, this is against their rules.
• A payment plan can be provided upon the client’s request, for commission order(s) that are $150 USD or more. I offer the option to pay 50% upfront and then the other 50% after the sketch is finished and you'd like to move on to refinement/coloring.
• The client is welcome to provide tips, at their own discretion, is not obligatory ( tips are greatly appreciated).
═══════ General Terms, Process & Time ════════
• Prices provided on the price list are not set. They purely serve as an orientation and are subject to change based on demand. I have the right to increase the pricing before I begin the commission based on difficulty, time scale, etc.
• I reserve the right to decline a commission request.
Any ill behavior will not be tolerated and your commission will be canceled if it occurs. If you fail to follow the rules provided I have the right to decline your commission.
• Provide reference pictures of your character, photo reference for pose ( if you have or want something specific), decent quality, and a fully detailed description of what are you looking for or any other details you think will be necessary for the commission.
• It’ll take me between 1-2 weeks to finish a commission. (once your commission has started, the time on the waiting list does not count).
This can be affected by factors such as Health, complexity, Work, or family issues. If any of the things stated occur you will be notified asap.
• All commissions are taken on a first-come, first-served basis. if you need the commission to be delivered by a specified date, please let me know in the initial request. Rush or urgent requests would need to be discussed and will require an additional fee. ( an additional $30 USD to $50 USD for rushed requests, and +$15 for every client in the queue)
• I will be showing you WIPs ( work in progress ) of how is looking the character at each stage of the process, so we both can be sure that everything is well.
The first WIP is a sketch to primarily show the character pose, layout, look, and composition of the commission. Once this is complete, the artist will notify the client for approval. The artist will send a wips at every stage of the process and once any minor edits have been completed to be approved by the client. Once the WIP image has been approved, the artist will continue on to complete the commission.
• You have 3 changes while I'm doing the sketches or the lineart (if it’s needed), but once I Start the coloring process the changes only can be about colors (these don't have any specific amount but only as long as it does not involve making a major change or repainting an entire area).
• I’ll send you high-quality images after all the changes and revisions are done. Note that there is no physical product.
════════ Cancelling & Refunding Policy ════════
• I reserve the right to cancel your commission at any time, for any reason. If I decide to cancel your commission, because I’m unable to complete it for any reason, you will receive a full refund, regardless of the progress I’ve made.
• When you are on the waiting list you can cancel your spot free of charge! Just let me know, preferably as soon as possible. When I have started work on your commission, you received the sketch and I started the refining, lineart, and coloring, there won't be any possibility for a refund. A refund will not be given if the artwork is complete.
• If the client is being unruly, rude, unreasonable, or disrespectful to the artist, for any reason, the artist holds the right to cancel the commission without a refund ( or only issue a partial refund, based on the artist’s discretion and the process made).
═══════════ Customer Satisfaction ════════════
• I will do everything I can to make my customers happy. However, after a commission is finished only small changes are allowed to be made. Such as small coloring/marking mistakes.
• Any great changes will come with an extra charge. Such as an outfit change, outfit addition or subtraction, background change, or anything that makes me have to redraw it completely.
• If your reference was unclear to start with, then you are not allowed to do minor changes without a fee. Make sure to be clear in your order about what you aim for.
═══════ Copyright / Usage Policy ════════
Copyright
• This is a private commission, so it can not be used commercially and credit has to be given in case you upload it online.
• The artist retains all artist copyright to the commission. The client cannot state that they or any other parties drew the commission or attempt to sell the commission for the client’s or other parties' own profit.
• If you break the copyright infringement in any way, every right you had to the drawing will be retracted.
The following is considered Copyright infringement:
Reproducing/using the copyrighted artwork commercially (Meaning making money from it), Taking Credit for the creation of the artwork. Removing any watermarks/signatures. Altering the artwork without my, the artist´s, consent.
REGARDING YOU, THE CLIENT
• You are allowed to share the artwork on all your social media, use it as your profile pictures, print it out for personal use, as wallpaper, etc, as long as it is for personal use only.
• You are allowed to claim the right of your character(s) but not the drawing itself. Please do not claim the artwork as your own, re-distribute/edit or make profits from the commissioned piece (reselling, uploading to POD services, making prints, etc.) my artwork under any circumstance unless discussed.
• You must give proper credit to the artist, using the artist's name, the Instagram, Twitter FA, or any other social media user of the artist (linking back to any artist profile is much appreciated).
• Commercial use is not permitted unless privately discussed and agreed with the client. You are more than welcome to contact me and discuss artwork for commercial use with me at any time. However, there will be additional fees for commercial use and will depend on the client's intended purpose for the finished piece.
• My work cannot be used in blockchain technologies, including Non-Fungible Tokens (NFTs), or in anything related to AI, Neural networks,s or any third-party software to replicate the work. Using my work for such is a breach of contract and is considered copyright infringement.
REGARDING ME, THE ARTIST
• I own all copyrights of the commission. I also reserve the right to copy, reproduce, and reuse the image for self-promotion and sales. That being said, I WILL NOT reproduce your commission with the intent to sell or for profit.
• I will NOT claim the intellectual property (IP) of the commissioned artwork.
• I reserve the right to post the commissioned artwork online, in my portfolio as well as in publications such as art books as well as timelapse.
PLEASE LET ME KNOW BEFOREHAND if your commission should remain private. I will respect and retain your privacy if desired.
• I will not draw: Fetish art, offensive or discriminative pieces, or overly complex character design beyond my skills. Stolen intellectual property or anything with malicious intent.
