Commission Terms & Conditions
Posted 2 months agoThe following is considered to be agreed upon commission request and payment of initial invoice.
1. I will not produce anything that would constitute a violation of law in either my (Australia) or the customer's country of residence.
2. I retain the right to refuse production of a commission for any reason.
3. The customer retains the right to publish and share their commission wherever they want, but they must provide credit and a link to me as the author if they choose to do so. Unless otherwise paid for, I retain the right to publish the commission on my gallery, crediting the customer as the commissioner and otherwise providing all credit and copyright to relevant individuals.
3a. For private commissions, I will not publish the commission. This does not limit the customer from publishing it themselves. If they choose to publish it themselves, they must provide credit and link as per requirements above.
4. Under no circumstances is my work to be used as training data for Large Language Models (LLMs) and other Generative AI (GenAI). Any customer whom I find has been using work I have written to feed into any sort of AI will be permanently banned from commissioning me.
5. I will work at a pace that I find comfortable and won't cause burnout.
5a. The customer retains the right to request progress updates.
6. I retain the intellectual property & copyright rights to any work commissioned from me (as per Australian Consumer Law) unless otherwise agreed upon via written contract. All characters within the works are owned by their respective owners.
7. If, for any reason, I am unable to deliver a product to the customer, I will refund in full any payments paid to me, less any fees third party entities take for money transfer, and subject to the exchange rate of the day.
