Sorting things out- Being my own Character
General | Posted 11 years agoFor those who I have talked to.. I have come to the conculsion that I am not a character Thief. Therefore I will be doing all sorta of stuff with Adara the Hyena. My previous journal was just meant to be silly cause of the accusation. So setting the record straight.. this is what I posted on my main account

"So I have a new fursuit named Adara, the brown hyena. I plan to make her a steampunk character or at least push the character toward a Victorian, or early 20th century character who is fascinated by all things Mechanical.
Now the story of why I have a Hyena suit to begin with is from when I dated an ex of mine. He also has similar looking character named Adara, who is a minor character set in Ancient Egypt. We dated, we decided to get a companion suit for one of his characters, we chose to get Adara made. My maker referenced a two pieces of art from two similar characters he had commissioned for his original concept back a few years ago. We broke up during the process of getting her commissioned. I paid for the suit, and already invested money in the fabric and the head was completed. My maker drew her own concept of the character and finished the suit according to how she drew it herself. So Yes, his character came first, but I paid for the suit. He decides to revoke my permission to use his character and intellectual property and he e-mailed the maker telling her she was to mail the suit to him when it was finished. As if he would get a free fursuit cause it was based off his "intellectual property" which he didn't draw the art, he paid someone else too. So the fursuit gets completed, and I have it, so my character is a Brown Hyena and I kept the name Adara, of which he has no creative right too simply because I do not appreciate him attempting to steal something I paid for. (and i liked the name) Adara is a 5000 year old Egyptian name. This would be like two people having a fox character named Holly.. WHICH btw there are other people who have drawn "holly fox" that is not my character.
Now, Here is the question I have and want to explore because I do intend on using the suit I paid for. I am I stealing his "intellectual property" because the suit looks very similar to his original concept art even thought her personality, her story background, and her time period and all her other characteristics are completely different from any story or plot he has his character involved in? At the time of commissioning i had his full support in getting it made. Now there are some differences such as color of the fur, ear color and eye color are different. He claims he was "bullied" after the break up to grant permission to use the character, but it is really "his" character?
Do looks make up the character? or does personality, background, storyline, etc make up the character?"

Ok. Complex situation here.
The Design is his. It is based off of his character Osiris- and clearly made for his storyline and universe.
However; He gave you permission to use that design to make a suit. The perimeters of his ownership now stop here. The Suit is no longer a design- and is now tangible property that you paid for. When he gave you permission to use the character; he gave you permission to buy and own a suit of that design.
Now that he revoked said permission- This only means that you can no longer use the suit "AKA - the design" to be his character.
You would have to be a different character. Which isn't an issue- as you are more than willing to make the character your own- Which; you did.
Example of this would be as if someone made a suit of Luthor. And Rukis revoked permission. "Please do not be my character anymore." They would say.. So then they would still have the suit- but they would simply have to make the design some other blue heeler. Rukis would not be able to claim the suit as property if they did not pay for it.
Clearly you can keep the name and suit if you make it someone else. In this case, you did.
He cannot revoke permission for the creation of a suit once it is being made. He can only revoke permission to use it "As that character."
You are more than allowed to be a Victorian Hyena that just so happens to look like his family race and share the same name.
However- I would personally change the name to avoid any literal malicious intention. He can cite you as using the suit as "Adara- His Adara" even though the character is now a different individual. You would still be going against intellectual property usage if you kept the name. "Dopplegangers" count as a crossing a line if they share a name, AND design. An easy way around this is to simply add on a second name. "Melidois Adara" (They can still simply go by "Adara") to differentiate your character design/personality from his."
As A Result.. I will give Adara a last name... I have a few Ideas.. right now I am leaning with Adara Hyenafaux.
