Please read through the terms carefully and make certain that you consent to the following.

Section 1 - Proper Credit
The artists ask that you credit them for the character design, don't claim you designed them! When prompted for the source, you're agreeing to give proper credit and redirects to official active accounts, such as:
● Their Toyhou.se
● Their Twitter
● Their DeviantArt
● Their Furaffinity

Section 2 - Do not trade/resell without permission
The artists ask that you do not trade or resell your purchased character/design without their explicit permission. When/if granted permission, the watermarked version must be used for commercial use rather than the original non-watermarked version to prevent art theft.

When asking for permission, the following intentions must be clarified to the artist you have purchased from:

● Artist must be made aware of who new owner of the design/character is, for the intent of tracing the use of the design if need be. (Also, we ask that you please direct the buyer/new owner to our T.O.S BEFORE confirming the trade/exchange).
● The mode of currency must be clarified. (Reselling in real currency after purchasing is not permitted).

Section 3 - Adopt holder Rights
● The client may make minor edits to the completed art (ex. Cropping, adding text/ borders, changing the colors).

● The client may use/reupload the design/character for personal/non-commercial use. Credit to the artist (@FigmentHaven) and a link to any of the artist's social media (Tumblr, Twitter, DeviantArt, Toyhou.se, Instagram) is preferred, but not required every time. If asked specifically about the designer/artist, please provide a link to prior mentioned accounts.

● The client may not use the design for any commercial use unless discussed with the artist beforehand.

● Adoptables purchased for commercial use will be charged more than personal/non-commercial adoptables. If you intend to use an adopt for commercial use, please clarify upon purchase. If you initially purchase without the intent commercial use, but end up wanting to use it for commercial use at a later date, please contact us before doing so. Prices are negotiable.

● The client may not claim the design as their own work, whether or not edits are made to the commission.

Section 4 - Payment

●Payment is to be made via PayPal only.
●PayPal payment is to be done in USD (United States Dollar).
●PayPal payment is be done using invoices. We will require the client's PayPal e-mail.
●The client does not need to pay extra for any of the PayPal fees.
●Payment must be sent within 72 hours after confirmation. Please have payment prepared.
●If ordering a custom adopt or commission, once passed the initial sketch phase, there are no refunds.

Payment related to adopt holds and auctions:

For pre-designed adopts, holds/reservations can be negotiated. We will base this off of the demand for the adopt as well as the buyer's circumstances. While holds are NOT guaranteed, feel free to ask! We will do our best to accommodate.

In an adoption auction, we ask that you commit to your bids. To respect the time and effort of the artists, as well as other potential buyers, please thoroughly consider your budget and how much you're committed to spending BEFORE placing a bid, for everyone's convenience. Payment must be made within the first 72 hours following the end of the auction, or the rights to the character will be forfeited to the next in line.
NOTE: Failure to follow through with a bid will affect your credibility and thus limit our willingness to do business with you. However, consideration and discussion can be had for the bidder's circumstances if needed. If there is failure to follow through with a bid twice, we will not accept any from you in the future, and they will be disregarded if placed.

Section 5 - Reclamation and warnings

We put our trust in our clients to have read through/keep to their word when agreeing to our T.O.S., first and foremost. We are set on being as understanding, cooperative and considerate with everyone as we possibly can be, so action will only be taken if entirely necessary. However, in the unfortunate case that the agreed T.O.S has been broken, we will contact and inform/give you a warning. Failure to heed said warning could result in reclaiming of the character/design and refusal to do business with you in the future.

Cases in which a warning will or *may be given:
● [s1] You are found reselling/trading designs/art without permission.
● [s2] You were found to have been dishonest about the currency used during a trade/resell, and/or received real world currency in exchange.
● [s3] You are found to be claiming you are the creator of the art/designs.
● [s4] You are found tracing the original art and claiming it as your own.
● [s5] You are found to be using a non-commercial adopt/commission for commercial use without permission.
● [s6] You have disregarded a first warning
● [s7] You have disregarded a second warning (in the case a second warning was given, they are not guaranteed).

*In the event of [s1], [s2], [s3], [s4], [s5], or [s7], we reserve the right to reclaim both the art and the character design, without prior warning or discussion, if we deem it necessary. In most cases, you will be contacted and informed, and that is it.

In the case of [s6], we reserve the right to reclaim both the art and the character design after contacting and discussing the situation with the client, if we deem it necessary. If the client is unresponsive for longer than a month, we will assume non-compliance and reclaim both the art and the character design. Negotiation is possible, but not guaranteed.

NOTE: Reclaiming is defined here as taking the right to the character design and the art, as well as the right to resell the design/art. You will not receive a refund for the design/art.
Any art of the character design made by another artist will not be claimed nor deemed connected to the design. If a design is reclaimed, we ask that you please inform any artist who has drawn art of it, or provide their social medias so we can do so ourselves.
Please know that, given the tedious and complicated nature of this outcome for everyone involved, it is an absolute last resort, and not one we want to have to come to. It is not an action that will be done liberally, or without serious consideration and reason.
