Terms of Service
By requesting a commission you’re agreeing to the following points:
- Every and all pieces created by the author (such as illustrations, designs, animations, animatics, logos, etc.) are to be considered pertinent to these Terms of Service.
- Each and all commissions must be paid fully (100%) at the time of submission (otherwise, no slots will be reserved), and be accompanied by its pertinent reference sheet (or the best image of them you can provide) in the case of characters, mascot’s photo in good resolution, landscapes, etc. In the case of not being able to pay fully, at least 50% of the total will be asked for beforehand, and this will require the rest to be fully paid before the final delivery of the piece. The author has the right not to deliver a piece of which the payment is still pending.
- If the client can’t wait (or doesn’t want to wait) until their turn in the queue, the total amount to pay will be raised by 50% for each piece they request under such conditions.
- It’s a requirement to deliver a clean reference sheet in good resolution (no +18 reference sheets will be accepted, in case of having one, it will have to be censored beforehand even if with a splat of color done with a cellphone’s image editor or whatever program the user considers convenient).
- No fetishes of any kind will be allowed, commissions with +18 and/or controversial themes will not be taken, up to and including (except for some non-explicit exceptions):
o No vore.
o No feet.
o No mawshots.
o No pedophilia
o No TF.
o Etc.
- The author has the right not to accept a commission whatever may be the motives (such as the themes being considered +18, controversial, fetishistic, or against the author’s own political or religious beliefs).
- It’s a requirement for the client to have a clear and solid idea of what they want at the moment of submitting the commission (or at the time of it being processed once their turn in the queue arrives). The client has the right to make three adjustments according to the initial idea during the sketch phase of the work. Once finished they have the right for two free adjustments (not considering a complete overhaul of the piece). After this there will be extra fees for each adjustment to the drawing based on the original price. Depending on the degree of partial or total modification of the work, and the type and level of detail required, a new price for the work will be given.
- The drawing starts being property of the person that paid for the commission once delivered, it can be re-utilized in any social networks or media, in whatever or whichever form they may deem convenient, except re-selling the drawing or profiting with it in in undue ways (for example: re-coloring it and profiting with the re-colored version), unless the client pays for the transfer of rights, in the case of a design they want to commercialize in the future).
- In the case of asking for the transfer of rights to commercialize with the piece in the future, it will be agreed by both parts through a contract under the 17.336th law of Chilean Intellectual Property, in which they will assess if the piece can be modified partially or fully by the contract. In case of requiring a contract before a notary and the DDI (Chilean Department of Intellectual Property), the client will have to pay, besides the previously agreed extra percentage, for the online procedure.
(The price for the transfer of rights depends on the total price of the piece).
- In case of there being delays due to pending works in the queue or slots taken, an estimated waiting time will be given after the commission is submitted. Both the client and the illustrator will have to respect the time established.
o The artist may, however, take some additional time or extend the deadline if he deems there’s a valid reason to do so (e.g. health problems will be considered a valid reason).
- Once the commission has been paid and the sketch phase of the job is done, there will be no refunds. If the client regrets the decision, there will be no refunds since it implies a loss of effort and time by the artist.
- To avoid conflicts with payments (such as possible scams or unintended chargebacks), a receipt will be either via PayPal or through the Chilean Intern Taxes System (SII). Otherwise a registry will be recorded through screenshots.
- Once the piece has been finished, it will be delivered in HD either through Sta.sh or directly to the client’s desired e-mail address. Permission will be asked to upload the piece to the artists’ social networks.
- If the client doesn’t respect the Terms of Service, modifies the piece without the artist’s written consent, improperly profits from it, harms, threatens or injures the artist in any way, they will be put automatically on a blacklist with the right to appeal accordingly.
