✦ TERMS OF SERVICE ✦

By commissioning me in any kind of way, you are agreeing to the terms of service below.
Any statement can be bound to change if discussed with me, the artist, prior to the commission.


I. GENERAL TERMS.
✦ I have a right to decline the commission
✦ Commissioners have the right to cancel the commission anytime BEFORE they pay
✦ I DO NOT take rush commissions unless fee is included
✦ I will only send an invoice if I accept your commission

II. PAYMENT
✦ Payment is made through a PayPal invoice. This TOS will be attached
✦ Prices are in USD
✦ Payment is upfront unless a payment plan is discussed and agreed upon
✦ If payment is not made 48 hours after the invoice is sent, the commission will be cancelled and the commissioner will be notified. If this happens more than once, the commissioner may be blacklisted if I have good faith belief that they are a troll.
✦ If the commissioner files a chargeback for NO reason, they will be blacklisted and put on beware
✦ If I cannot complete the commission for any reason after payment has been made, I will cancel the commission and refund the commissioner

III. PROCESS
✦ Commissioner will get to greenlight the sketch before I move onto lineart and colour
✦ Works in Progress (WIPs) will be given when I make significant progress
✦ I will update the commissioner when I complete the sketch and when I complete the flat colours; these are the two times the commissioner will get to correct design mistake and colour mistake respectively
✦ I will also provide them if I have any questions during the work process
✦ If anything happens which may slow down the process, the commissioner will be notified immediately

IV. CUSTOMER SATISFACTION
✦ Any changes are allowed to be made if I, the artist, has made a mistake (such as colouring or character details)
✦ Commissioners should make sure that they are clear with what they want to ensure the best quality outcome.
✦ Major changes must be made during the sketch stage so please be clear and concise with any changes. This includes no more than 2 changes that are not corrections.
✦ I am not responsible for lost art after the commission is finished. I will email each client with the piece and ask them to confirm that they have received it. (Sometimes I may keep the file, but I clean my art folders once in a while and they will eventually get deleted)
✦ Clients should let me know if they have a due date I must abide by. However, this must be done pre-payment and I reserve the right to decline the commission if I think the time frame is outside of my abilities.

V. COPYRIGHT / USAGE POLICY
✦ I, the artist, hold every right to the produced drawing, not the commissioner.
Therefore I´m allowed to use the copyrighted artwork to;
✦ Promote me by using the art in a portfolio
✦ Post it on my social media (I can bump back dates at the client’s request)
✦ Other personal usages which do not infringe upon the commissioner's copyright of the character

The commissioner is allowed to;
✦ Use the copyrighted artwork for personal use only
✦ Print the art for themselves or as a gift.
✦ Claim the right of their character(s) but not the drawing itself.
✦ Use the art on their social medias with credit to the artist.

Housekeeping
✦ I will watermark the commission piece of original characters to keep others from using it. However, the same cannot be done with fanart of characters we do not own.

The following is considered Copyright infringement:
✦ Reproducing/using the copyrighted artwork commercially. (Meaning making money of it in any way)
✦ Taking Credit for the creation of the artwork.
✦ Removing my signature without consent
✦ Using the art for promotional images in advertisement
✦ Using the art as a brand image (for example, using it as a logo)

Commercial Licencing will come with additional fees. This is NOT available for fanart of characters the commissioner does not own.
✦ With commercial rights, you are allowed to make any sort of merch with the artwork. Use it in books, covers, as Props, change it to your liking and promote your own brand with.
✦ Credit is still required for usage of the artwork, even if altered or edited.
✦ Markups will differ depending on what the art will be used for
