By agreeing to commission me you are agreeing to abide by my Terms of Service. We are both bound to everything that is listed below. This document is intended for those who are commissioning for personal use only. All commercial work terms and regulations are to be discussed separately.

**General Conduct:**

-By placing an order, you are **agreeing that you are a legal adult** in your country of residence.
-I reserve the right to decline an order for any reason.
-I work on a large canvas, (Original starting at 10in x 17in or about 25.5cm x 43.5cm at 500 dpi resolution). If need be I can work on an even larger canvas for personal printing. Please ask. Final image is almost never the full size of this canvas but never deviates lower than 2000 x 2000 pixels.
-I reserve the right to post the work to my personal galleries or use in my portfolio for advertising. You may request to remain anonymous at no additional cost. **(If you wish to keep the commission private, as in I will not post it anywhere or use it as a portfolio piece there will be an added fee to the final quote.)** However you may request that I wait to post the image anywhere if it's being created as a gift for someone. Please let me know.
**-I reserve the right of artistic license on any aspects of the piece that you do not give specifications for.**
-I will make all of my working projects visible via Trello. (Found here: https://trello.com/b/wwFZP6o4/michaelis-work-queue )
-Please do not request that I copy another person's style. There are several reasons for this. The major being that I personally do not ever feel I'll do that person justice.

**Subject Matter:**

-Unless otherwise requested, **orders will always be SFW (Safe-For-Work)
-**Anything considered NSFW (Not-Safe-For-Work) will be charged an additional fee.** This content includes though is not limited to sexual imagery (arousal), sexual acts and extreme gore.
-**Nonsexual nudity will not result in a fee.**
-**I WILL NOT** draw scat, loli/shota (Or any sexual themes of this nature including any character that may be under legal age), hateful imagery, or political viewpoints of any type.
-I WILL draw some fetishes, furry, feral, humanoid, NSFW and some other things. Please inquire if you have any questions.

**Copyright:**

---

-I retain full copyright of the completed piece. I will not sell completed works depicting a client's character or characters without express written permission. This includes: prints, merchandise, or patron bundles (if applicable). However I reserve the right to use the work for personal self promotion with credit to the original owner of the character whom can choose to remain anonymous if requested.
-By accepting your commission, **I give you the following rights for personal use**:
-The right to share and upload the work with proper credit. (A link to any of my galleries or websites)
-The right to crop or adjust the image for use as a wallpaper/icon/banner/ect, or any minor editing/filter application required for such. (Including additional protective watermarking)
-The right to redistribute the work in situations such as character sales or transfer. (Note I have no issues with my commission price being included in any re-sale pricing.)
-Coloring a sketch or lineart.
-I **DO NOT** permit:
-Heavy editing of the work (drawing over, erasing, manipulation, ect.) so that it becomes a different piece.
-Sale of the artwork via prints or other merchandise, including digitally. *Unless a commercial agreement has been affirmed in writing
-Removal of my logo/watermark/signature. *Full resolution images are given for your personal viewing and enjoyment. I will also provide a lower resolution file that is ideal for uploading to make it easier to share.

**Process and Alterations:**

---

-Turnaround times or expected delivery times will be discussed prior to any invoice being sent so you can choose if that is something that works for you.
-If anything happens that the commission will possibly take longer than discussed, I will notify you promptly.
-WiP (Work in progress) will be sent at the initial sketch phase and linework stages (if applicable) to make sure that you are able to let me know if corrections or alterations need to be made before moving to the next step.
-Unless you have given me advance notice, in the event of an absence if I do not receive feedback **within one week's time** I will move on to the next step of the process.
-3 major changes are permitted in the refined sketch phase, and 2 more in the lineart phase (If applicable). Anything in the final stages will not be altered unless I have made a mistake or missed an important detail.

**Streaming:**

---

-On occasion I may work on commissions during a livestream. No references will be visible during these streams.
-If you would not like me to work on your commission during these streams please notify me ahead of time and I will not work on your piece during the session.
-I do my work in order of operation. I will only guarantee to create specific pieces on a stream if you request the work be done only during streaming sessions.

-In the event that I save the stream to upload the process to my youtube channel you may request that your piece not be included. Please let me know if this is the case. (Found here: [The Dragon's Den] )

**Ordering:**

---

-**Please submit your request with the form provided.** This helps me keep track of all the information needed to complete your request.
-When using the form please submit one per item unless ordering items that are the same character and same type. (Ex: two sketches of the same character)
-To receive a quote for **commercial use**, please contact me through my business email (dragonstidegifts[at]gmail.com) and include “BUSINESS INQUIRY” in the subject line.
-Visual references are ideal though I can work off a written description if required.
-**Projects with no provided visual references will have a small upcharge.**
Note: I can work with a character description though I ask you make it as thorough as possible in the absence of any visual aid. If you're having trouble with descriptions please feel free to ask and I can point you in the direction of someone who may be able to help. If there is dissatisfaction and we can't work out edits a partial refund is available.
-If you are **ordering for a deadline** to be met please place your order at least **four weeks in advance**.
-Orders with a deadline of less than 3 weeks in advance will be charged a **rush order fee** of no less than $20 USD up to a max of $200.
-Completed work will be sent via your preferred delivery choice which will be specified in the order form. **Please double check the accuracy of your order form before submitting.**
-Any **changes to delivery methods** must be requested via e-mail with the subject: “Commission: Delivery Change Request”

**Payments and Refunds:**

---

-I accept payment via Paypal in **USD only.**
-Payment is to be completed via invoices. DO NOT send me any payment that I have not sent you an invoice for.
-Payment must be cleared before I will begin work. Anything totaling $100 or more is subject to paying at least 50% up front and the rest paid before I complete the piece. Anything less than $100 is to be paid in full before I begin work.
-If prices change between the time you submit your order and the time I send the invoice I will honor the **lowest rate**.
-Refunds are available: Partial refunds are permitted for work I am in the preliminary stages of (i.e. the sketching and researching phase) or in full for anything that I have not yet begun. For colored or completed work a refund will only be permitted if you forfeit usage rights of the completed piece so I may reuse the sketch to sell as a prepose base or YCH (Your Character Here).
-If a partial refund is granted, you will receive the progress up to that point. **DO NOT** pay another artist to finish my work without my permission.
-**If you do not pay the second half** of your payment on an order of more than $100 you automatically forfeit usage rights of the piece so that it may be used for prepose bases or YCH (Your Character Here).
