Actually, US law says that there's nothing wrong with taking a picture of a compete stranger in public areas.
I know this from my work as a Journalist.
the only way this would be fraud is if the person who took the photo tried to either take credit for the suits or if they were trying to somehow monetize the photo especially since those characters are Intellectual property :3
