No I didn't think I was braking any FA rules and I still don't, for the flowing reasons: I am not saying it is mine, I am not reselling your work or this one, it is not a copy and pasted then colored in piece and I cited a reference giving you credit with a link to your picture. Literally the only thing I used from yours was the pose or body shape to do a simple drawing for me and me only. If I did or didn't do any of those things, that would be a different story.
If you want me to remove this I can, with all respect to you ill take it down imminently. Not because I feel I did anything wrong, but just because you are obviously getting upset over this.

But you DID do something wrong. Without the artist permission, you are violating US copyright law, which protects the artist. In strictly legal matters, it is against the law, and it is against the terms of this site as well. If you had asked my permission and I had granted it, then you would be fine. But you did NOT ask my permission, and quite frankly, I AM upset about this. I would appreciate it if you took it down voluntarily, as you offered.
I have no problem with youngsters using my work as a basis to learn from, but please keep it private and don't post it online anywhere. I am required my law to defend my copyrights or I may lose them.
Also, look at this way- I let someone who traces my artwork get away with it once. Someone else sees that, and then they start tracing my art all over and SELLING it, because they think they can get away with it too. At that point, I'm losing money and my livelihood is in danger. I cannot allow that to happen. Also, the client that I did the original artwork for is quite frankly upset at you because you ripped the linework that I did on commission for him personally. He had a one of a kind piece and now there's a copy of his character's line floating around. He's miffed about that.
Please remove it and I will have no hard feelings. And a friendly note to a budding artist- join some of the stock photography sites- they are there for the purpose of reference, many are free, and you can learn much much more from drawing from life that from copying someone else's lineart. We all have to start somewhere.

Ill be taking this down at your request and out of respect to you, but I really didn't violate any copyright laws.

Like I said, " I did not say it was completely mine nor am I reselling your work" and I do not want to sound rude but Hasbro is the owners of the MLP franchise, not you. They feel the same as you when they see what you do.
.
What you do in my opinion is your own work though. Everything from your badges, to your adorable plushies and your commissions you do for the fandom.
That is your work and I don't feel bad buying something from you.
.
(I would really like to commission you to do a plushy Neon for me btw, if you are not too mad at me and if you are taking any orders?)

I suggest you might want to read up on how copyright law works, because even though you did cute reference, it's still a violation. Trust me, being that I run a business based in art, I know copyright law very well. You can get lots more info on copyright here: http://www.copyright.gov/
And yes, you are correct about Hasbro owning the MLP franchise, and all fanart is under their trademark. Hasbro allows the fan works but can revoke that at any time. Though they can't claim anyone's personal characters as their property, and since I have been drawing original characters....
Anyway, thanks for agreeing to take the image down. I want to encourage you to keep working on your art and learning. You'll only get better with time, and eventually you won't need reference.
As far as orders, I'd be happy to take an order form you in the future when I am open and available. I'll post a journal when I am. Thanks!
