thank you for further proving who you are xD
you're not free from admins on FA like you were on F-list.
Dunno if you notice but many people put "Pokemon © gamefreak" or nintendo and the character idea itself is theirs. the fact that your doing this just to stir up trouble is digesting. Please act like a human being and cease being foolish.
If you wish to make friends this isnt the way to do it.

You're anything but friendly, and your attack on me by calling my art "trolling" while it isn't, and continuing to assault me with insults, is harassing and quite a foul up on FA's rulebook. If anyone broke any rules, it's you, my blue-marked ratty friend. :P Luckily for me, I can simply just block you and report you for harassment, which nothing's going to happen to you, sadly for me.
And you're harassing me and bringing personal drama into this. This falls as a violation of FA's code of conduct. I stole nothing, I've been rather inspired by whatever I saw on the internet, if that's plagiarism, then creativity today is dead.
You are blocked. Good day.
You are blocked. Good day.
Oh dear. I tried to warn you, hun.
The art you previously stole wasn't you own creation, and you got into trouble for it -- well, sorry to tell you, but this isn't your own creation if you took THIS MUCH inspiration from someone else's art, either.
Everyone who is likely to see this picture is already familiar with the real, original Mewlava.
You will get no respite from insults while you try to abuse it.

Copying a species falls under no such copyright as far as fan-art and inspiration sees it. I've broken no such rules and as such I am perfectly fine within the bounds of creating a character and drawing a character based on a species that someone else created, which isn't as far as I know, copyrighted, nor is a color scheme copyrighted, and as such falls perfectly fine with inspirational and fan-art.
As far as I know, I've been warned not to use the owner's own images, not my character, Emmy, which I based off Jem's species, not his character. See where the line is drawn?

If your defense is "yeah, but I can't LEGALLY be punished", then you're really missing the ethical point.
It doesn't matter where you think the line is drawn; others can see plainly for themselves that you've stolen someone else's original design. It's irrelevant that you've slapped a new name on it and overwritten the canon.
More simply put, your feelings don't matter. It's Jem's that matter, and how you'll be perceived that matters.

I don't view Pokemon fusions to be anything but original, such as any Mew fusions, they've been overdone as hell, no offense Six.
It's like coming back to Sonic OCs, which weren't OCs, they were designs taken by someone else, aka Sega, and people complained of other people copying them.
If you're going to start throwing a tantrum over intellectual property, look at Gamefreak/Nintendo's Quilava and Mew designs, then tell me that you and Jem did NOT take someone else's idea and fused it into your own, and then one of you started complaining that someone else took the design that was INSPIRED by Gamefreak and Nintendo's Mew, Sandshrew and Quilava copyrighted characters and called it 'ORIGINAL'.
Jem nor you owns the rights to the Mewlava species, nor is the name copyrighted. If this is a battle for ethics, you've come to the wrong place. Legally, once again, I am not liable for any kind of consequence because I am perfectly fine within my rights to use the species and color scheme for a character idea. I created a CHARACTER with MY OWN ART, as in, I DREW IT MYSELF, not you or Jem or anyone else, me. It is BASED on Jem's species.
There is no character theft going on, if you're worried about originality, then I'm sorry, but that went out the window when everyone started doing Mew and Quilava fusions, two overrated Pokemon characters at that.

I HAVE to credit someone else's 'creation' that they took from someone else's creation? Good lord! Did Jem CREDIT Gamefreak/Nintendo or Ken Sugimori when making his Mewlava character? Should I credit people's characters based off already copyrighted characters now? What has this society fallen to I wonder.
Either accept the fact that I did base this CHARACTER off a species that existed, and I stole NOTHING, or accept you're also harassing me like every one of Jem's friends are doing right now. Otherwise, please cease commenting on the issue, it's irritating the hell out of me.

As in, MY CHARACTER, EMMY, A MEW AND QUILAVA HYBRID. As in, a character I made based off Jem the Mewlava's species.
If there's such a thing as inspiration and fan-art, this would be it. If it's not original, I don't care if it isn't. But there's no character theft happening here, nor is art theft: I drew THIS Mewlava on my own computer, with my own tablet, with SAI, and only copied the species' color scheme and form, and this is NOT JEM, this is EMMY, a laboratory subject that escaped from, duh, a lab during testing, the collar she wears is proof of it. During the character's creation, I used Jem's image made by DM without knowledge of who Jem was, and guessed exactly what the species were, between two names and chose it, picked a storyline and the best I found was a hybrid of Mew and Quilava being used for experimentation and achieving different results.
There is no theft going on here, and as such, I am legally within right. Consult with any CREDITED and LICENSED copyright agent or lawyer, and they'll tell you the same.

Cool. Call your lawyer. Every layman on FA knows exactly what you've done, and you can ask any one of them for their opinion.
You "copied the species' color and form" and "based it off Jem the Mewlava"... so, what exactly did you create for yourself, here? :? A background story?

Perhaps you're not reading my comments, and as such, you should refrain from responding with bitter sarcasm or intentional harassment.
I will repeat again:
I created a character based on Jem's species, the character, Emmy, is owned by me, as is the art.
And yes, a small background story which can expand to a much bigger one over time, as such as my roleplay methods in F-list in other places.

I see. So now that we've discovered your sole creation is a mere "background story" - despite the fact the character you viewed in the image you originally stole already had one - you think this character is still somehow your invention?
No lawyer would defend that. You're a fool. You don't own something simply by virtue of being ignorant that it was already owned.

You aren't quoting me. You are basing petty arguments over a 'background story', which is more than that, and I've already said it, it's a character I created based off Jem's Mewlava species.
And Jem is a character based off a copyrighted character or two, so tell me, if I'm 'stealing' from Jem, isn't Jem 'stealing' from the intellectual property rights holder named Gamefreak/Nintendo? I bet you have something different about your Quilava too that makes him "Unique" from a sea of Quilava that are owned by someone else but it's actually owned by the big company, and are fan-art and based off those characters.
Hypocrisy isn't good for you, and it makes you look a bit bad.

Permission is the key concept here.
If all Pokemon characters are stealing ideas, what's the difference, you ask?
Well, Nintendo and Game Freak have their copyright under 'creative commons', so that people can make "substantially derived works" without feeling threatened. In short, Nintendo gave their permission. Jem used that permission to derive his own idea. You did not then get Jem's permission to use that idea. That's how it goes, really.
Oh? No, I'm just a quilava. Just 'lava. No hypocrisy, here.

Allow me to counter misplaced legality over correct legality: http://en.wikipedia.org/wiki/Derivative_work
I hate to see this dredge on and to be burned in the process, but I feel like being a pompous jackass and share my thoughts to share. For fan arts, if it isn't an original character or concept [such as a fusions of Pokemon, it's iffy that it can be copyrighted under that person under the cause of derivative work, especially if it so obvious has elements. This can be more said off the species than the character.
And have anyone take take the time to look at the differences and similarities between them before calling it theft? If he had indeed either drawn Emma to be exactly like Jem or had taken an imagine drawn or commissioned by Mewlava, that could be be labeled as theft. Because I'm an anal person that likes to take to take a look how strong of an argument is, I took the freaking time to do it and all the various artists and Jem's own versions of her character and Foxfire.
1. Jem has huge ass feet paws. To the disappointment of feet fetishes, Emma does not.
2. Emma seems to only three fingers, at least on the visible hand, more like a mew if I remember right. Jem's got four.
3. They have different looking accessories. Emma does not own a bandanna. Both do have colors but they are different. Jem's looks like a standard pet's color with blue material and gold metal tag, in shape of an eye; Emma's purely metallic, looks like a neck/foot brace, and metal gray with a gold coloring in the front. They aren't alike.
4. With the 'hair' there some similarities. Jem's got the uniqueness that some of the pictures has her with longer hair in the back. For the front of the head, majority of Jem's seem to be longer.
5. Jem sometimes is missing inner-ear tuft. When she does it's lighter compared to this picture of Emma.
6. The tails, especially at the end. Though length can't always be seen, I'd personally guess Emma's is close the length to her body while Jem's vary from the same length or longer. What can be seen as really different are how the end of the tails are. Jem's tail fills out into a large oval. Emma's got a 'dent' before coming out as a little ball.
7. Emma doesn't get sexy pic of ending up in a ditto pool.
Number 7 aside, it's safe to say there's some variation in the pictures. Even if what I'm saying is nothing more than cat piss, the key should be what MEWLAVA THEMSELF SAID:
"Welp."
Was not "Welp, someone's a thieving bastard." Hard to tell the exact emotion, but guessing the people playing white knight didn't ask Mewlava's opinion of Fire's work and if they should lead on a crusade with a weak argument, because they happen to be the same species. And I'm pretty sure, they both know each other. It'd be sorta awkward, and that Fire acknowledge that his hybrid isn't the only one in existence.
Moral of the lesson: If you're going to waste a half hour of life arguing something, at least be able to prove that what you're screaming isn't crap and can be backed up besides something being same species and color. And I need a goddamn hobby.

I know this is.. well, an ancient post/argument, but I should point out, having know the original Mewlava myself, (only for a small amount of time due to a fallout) his simple "Welp" Is essentially a condensed "He's a thieving bastard". Or just a general condensed form of distaste. Just thought I ought to say...
