
There is an organization that has been sending DMCA notices to artists who are selling art with the phrase "Fight Like a Girl" in it. The entity (a cancer charity) holds a trademark register for that phrase, and they think that allows them to boss artists around. The thing is, it's a COMMON PHRASE, which means they can't dictate how people use it if it's not in conjunction with their specific business/organization/agenda. I'm encouraging artists with this phrase in their work to stand their ground and not alter their work, if they feel comfortable and are capable of doing so. To put my money where my mouth is, I made my own design and put it up for sale on my Redbubble and Etsy store (not that it's a serious design that I expect anyone to actually buy). Let's see what happens!

I saw that going around tumblr, I agree with you its bullcrap. I know they're a charity but making artists take down their work with the phrase- thats got nothing to do with what they're trying to use the phrase for isnt right. The artists work in no way keeps them from getting donations- sad to see such bullying about it :/ This is a nice piece also!

inkmaven's comment above, I would so totally want this as a shirt, especially being one of only a handful of female tattoo artists and animator hopefuls! I was the ONLY female in my animation classes. I wish I'd had this as a shirt back then, especially since I ended up coming out top dog in them LOL!

wut, can they even trademark a phrase used that frequent? Even so -I've never really heard of people doing DMCA's over slogans.
my first thought when I was this image was that stupid phrase "be a man and stop fighting like a girl" or along those lines - which I find really stupid, I rather fight a man than a girl any day of the week, and that comes from a girl xD (we fight dirty)

You can! But to my knowledge the trademark registration is only enforcable IF infringing art/materials are obviously related to the trademark holder's agenda/business/etc. Which is a nice in between to protect certain works but allow free use of common phrases in other contexts. Problem is, the entity issuing DMCA's is doing so for works that clearly have nothing to do with them, and just blanket-firing at any art using the phrase. Uncool!

This is just a great little piece on its own (it's always cool to see you draw humans!), but on a more serious note... good god, I can't believe this is actually a thing that's happening. "Fight Like a Girl" is a pretty inevitable deviation/reversing sexism/etc empowerment turnaround of the ubiquitous FIGHT LIKE A MAN thing, so how the fuck can people possibly think it's unique or valid enough to legally copyright?

You can't own the phrase as it applies to everything, but you can reasonably defend it when someone else uses it in conjunction with products that closely resemble yours or your agenda/business/etc. The DMCA's artists have been receiving don't fall even close to cancer charity related things, so it's pretty unreasonable to tell them they can't use the phrase.

No, as far as I know she is unrelated actually! She owns a self defense organization for women with the same slogan, but as far as I know she isn't behind this rash of DMCAs. She has defended her trademark before though I'm not sure about the circumstances. Unless I'm misinformed, I think that's it!
I remember when the Candy Crush company tried to trademark the word 'saga'. They sent Cease and Desist letters to every game that included the word 'saga' in it, even games that existed a decade before Candy Crush. I feel like common words and phrases shouldn't be able to be trademarked. Also it's SUPER CRAPPY for a cancer organization to try to take a phrase all for itself. Why don't they spend their money and time on actually researching a cure rather than going after independent artists who aren't hurting them at all?
