But for the record, absolutely no "deal" was made. A C&D sent from BD to teespring, then to myself, then they made their own "team shirt" then they REVISED the C&D and sent it to tumblr, for prat's blog, of all places?
Anyway, this is going off on a tangent separate from your comment but I'll leave it here, in case people stumble upon it and are curious for additional info:
I've said it before, but we sincerely figured "Bad Dragon Bruisers" would fly under fair use, being distinct from "Bad Dragon" and "Bruiser the Fusion," as it's for an entirely separate product/audience from silicone dicks, and intended to be a parody for our fake sports team. Looking closely at their trademark, it doesn't seem to cover apparel, though I'm hardly an arbiter of law. If I wanted to contest the C&D I -probably- could, according to what I've been told by multiple sources, but they are not baseless in sending one either, and we intend to comply and improve the design anyhow.
All in all, I'm discovering IP LAW IS FUCKED lol
Anyhow, THE MAIN POINT OF CONTENTION/AMUSEMENT BEING: SENDING THE C&D /THEN GOING AND MAKING A WEAK COPY OF THE IDEA/ that stands out from the "neon savannah" line like a sore thumb.
I think people are making it into a bigger deal than it is, just with BD's other shady practices and documented history of doing this EXACT kind of thing, it's hawhawhilariousss

OH no people on the BD forums think that it's ok for BD to basically rip off other franchises, but someone does something that has a similar to their brand and they flip shit :') I probably should've been more clear about that last night. Like, i was literally told "we have no idea what deals bad dragon did under the table with those franchises"

I think the problem with me is how close those characters look, especial the Nick and the Bison guy. When someone posted the pins on FB, I honestly thought they were real Disney licensed pins.
I'm surprised with a company like Disney, who made nurseries clear murals featuring their characters, that they are either letting this slide or haven't noticed.

Yeah like, the art for the night fury, tauntaun, MLP, and Zootopie characters all look like what they are supposed to in the art. They look like...cheap chinese knockoff-style art. Like, it's similar. Like, the zootopia ones look EXACTLY like nick and judy and the thing that irritates me the most is that "Austin" and "Alice" look rather....cubbish?????? it really bothers me like, it looks like fucking cub art.
I think and hope disney just hasnt noticed. and i know for SURE Lucas Film would NOT be ok with the "snowstrider" as im part of a star wars costume club and Lucas Film and Disney /BOTH/ have contacted the club and explicitly asked them to keep things PG rated to preserve their image.

I've worked in a civil law (internship) handling copyright cases, and this is actually pretty status quo for a company to do, which is defend their trademark tooth and nail, otherwise they can lose it.
You could maybe contest it if you wanted to, (that is prohibitively expensive), but I wouldn't go around and blame Bad Dragon for this problem, I'd blame the law. They are doing what is expected of them so that some other external source doesn't come in and take their trademark, and uses you guys as an example as to why they can in a court of law (Which they can win, because they'd point out that BD allowed you guys to profit off the name, therefore so can they). Sorry you guys had to be thrown under the bus for business, but you have to understand that it is entirely a matter of the name being on the shirt.

OH yeah you are absolutely right, and I was reminded of their obligation to defend their trademark otherwise risk losing or at the very least weakening it. This is something I knew, but again, misunderstood with regards to -our- use of the name.
I had a very very TL;DR write up on the whole situation which I have since scrapped, but basically: I acknowledge that even if we COULD contest the C&D through whatever legal loopholes there might be (if any) we totally made a miscalculation in what we thought could be considered parody from the start, and as always I'm gonna comply with the C&D.
