They may both be wrong, but for different reasons.

"Theft" is wrong not so much because the thief has an item, but because the original owner is bereft of it—which doesn't happen in copyright infringement, which is more about intangibles (the credit, potential sales, or other such things).

What you believe about one you needn't necessarily believe about the other.
