No, DC and other companies like people doing fanart, even as commissions. It should even be protected under American IP law. The problem would only come if you made a mold and made it in bigger quantity - that's when you need distribution rights.

Are you sure about that? Because i'm fairly certain earning money from a copyrighted character would be a pretty dangerous thing. For example, what if i started creating Mickey Mouse figurines and earning money with that? Im very sure Disney could easily sue me over that :0
I don't know about this artist but i think if DC found out about it he could get some problems, unless he has a contract with them or whatever. There are copyrighted characters i would do as a commission (e.g. Pokemon) because the owner is very very very unlikely to sue, but DC... geesh, rather not risk that.

The distinction I think is pretty much whether you advertise, "Hey, I draw DC characters if you pay me" - that might be a problem if you got big enough to trip any laws. But if you said hey, I'll draw something for you if you pay me, and that person asks for a DC character, there's not a problem. There are people who even make a living through Patreon advertising the fact that they do fanwork - just as long as you don't say "hey, I draw Jinx from League of Legends, pay me for it," and make like $5k+ a year doing it, it's fine.
But isn't that really similar tho? Advertising myself as "hello i make DC characters" or just making tons of DC characters all the time kinda has the same result D: Eh, this sounds so risky. Im pretty sure if the companies REALLY wanted (most won't do anything of course) they could easily sue those artists. I will avoid this stuff
