TERMS OF SERVICE

It is your responsibility as the Client to fully understand these Terms of Service before agreeing to them. Users must only 'sign' once unless otherwise notified, but it is recommended you keep up to date on any revisions. Faeyne Silvercloud's Commissions TOS


AGE
You as a client must be over 18 years of age to order artwork that is in any way suggestive: nudity, porn, intense gore, etc. It will be required of you to send some form of proof of age. For the safety of both commissioner and artist involved.


PAYMENT
All payments should be in USD. Via Paypal. All payments will be made through invoice method. DO NOT send me the payment, it will be refunded.

Payment is due in full up front for any commission. Payment plans can be discussed if necessary. At least a partial payment is required within three days of your commission request being accepted. Failure to do so will result in your request being dropped. If you need more time let me know.

If you wish to cancel your commission during the sketch stage, a 25% cancellation/sketch fee will be charged, and the remaining 75% will be refunded. There are NO refunds available for completed work. Depending on how much work has been completed at the time of a refund request, it may not be possible to issue you any refund. If you need to change your picture idea, or remove a character, it will be discussed on a case by case basis, or the artist may offer you a credit for future purchases. There are NO refunds available for completed work.

The Artist reserves the right to issue a refund and cancel a commission due to poor communication or rude/inappropriate behavior. If you have already been issued a sketch, 25% of your original payment will be kept. If personal issues come up and the Artist is unable to complete your commission, you will either be issued a full/partial refund or another agreement shall be worked out.


COMMUNICATION/CONTACT
Email is the primary use of communication for the Artist. In order to receive a quote you must fill out the Commission Form or follow the appropriate directions from the artist for certain types. Do NOT use instant messenger, private notes, comments or public forums unless specifically directed to do so. Incomplete forms or failure to follow instructions may be subject to a fee or denial of service. Do not instant or private message forgotten details. Unless another form of communication was discussed/determined easier, send an email to silvercloud.vale[at]gmail.com if you have more to add!
Emails will be answered within 3 business days. If you have not received a reply after 3 business days, please re-send your email. Contact will be considered lost if there is 1+ months of unresponsiveness towards sent notes or emails.


WORKS IN PROGRESS
All orders will be shown a sketch by default, sometimes with a choice between more than one pose, and from there any color editing if color is involved. Special offers / artistic freedom type commissions, may be exempt from this. If you would like more updates, you are encouraged to ask for Work-In-Progress updates at various phases, and the Artist will do their best to work with you.


IMAGE CHANGES
You will have the opportunity to request changes to the commission in the Sketch stage. No more than three revisions (or equal in terms of small alterations) will be made unless you are willing to pay an additional fee. You have no right to any previous sketches, and the Artist reserves the right to reuse sketches. Any major edits made after the sketch stage may be subject to a fee or refusal at the artist’s discretion. It is your responsibility to point out coloring errors in the color phase, and changes after the color phase may be subject to an additional fee or refusal.


STREAMING
The Artist reserves the right to stream work on your commission unless you have specified that the commission shall remain private until posted. You may also request that the piece only be worked on while you the customer are watching the stream. You can discuss times available with the artist by email.


POSTING AND IMAGE RIGHTS
The Artist retains the right to display all commissioned work on any personal website or galleries. If the commissioned work is a time-sensitive gift the Artist may delay public showcase as per your request. If you wish to have your work not posted and remain private, you MUST specify this when filling out the commission form, or you may choose to remain anonymous and not be credited in the posted description.

The commissioner may upload the work done for you to your site as long as it is credited and linked back to the Artists Furaffinity (Or otherwise noted art site). Once a piece is commissioned, you may use it for any personal use that you please, including but not limited to icons, signatures, layouts, wallpapers, themes and personal site display. You will be provided with the preferred upload size. You are NOT allowed to post or otherwise distribute the high-resolution file anywhere. You may not claim the work to be your own, edit or set it up for redistribution. You may not use it for any external projects, commercial or non-commercial unless agreed upon, and you and the Artist have a written, signed Image Rights agreement. If you are not sure whether your request counts as personal, feel free to discuss with the Artist about its intended use.


ARTIST'S CAPABILITIES

THE GOOD: Animals; Dragons; Gryphons; Hippogryphs; Unicorns, and really any mythical creature you can think of; Any closed/created species (so long as it is your own); Anthros; Artistic nudes and other suggestive themes; Porn (only when offered as YCH's, or as special gifts to close friends); Gore for the most part; Etc. I am capable of doing just about anything you can think of, just ask away!

THE MEH: Mechanical things of any sort; Elaborate clothing – though clothing in general still kind of escapes me; Humans – especially faces; Some fetishes – Vore, Bondage, Feet/Paws, etc. There's probably more. I have very little confidence, experience, and expertise in these departments, but I can give it my best effort if these are truly what you want!

THE NOPE: Certain fetishes – Scat, Watersports, Gas, Diapers, Overly hyper anything, Anal/Cock Vore; Rape/Non-consensual advances; Abuse of any kind; Torture; Cub/Underage; Beastiality/Zoo/Pedophilia. To name a few, I probably missed some. I am all for people having their fetishes...but there are some things that I am extraordinarily uncomfortable drawing, and will refused to do so. If unsure if your request would be considered in the 'NOPE' category, just ask me, the worst I can do is say no.
