Spooky just loves being tickled, so she's glad to let Tobias the witch hunter "torture" her!
Spooky's real power comes from her self. She's a true witch, not simply a wielder of arcane artifacts. The topaz she wears around her neck acts like a battery and passively absorbs power from her aura. When she needs to, she can draw power from it rather than expend her own stamina. Basically all taking it away does is prevent her from tapping into that extra energy. She's still got plenty of her own!
Also, the robe and hat she's been wearing are just part of her Halloween costume, they have no magical properties!
