Is it ok if we make our own salazzard or salugia designs? Me and an artist friend were working on a salazzard design before she went on a hiatus, and also around that time discussing to make a salugia design, and I would personally want to still have them as characters, and they will of course be completely unique to yours, I just don't want to make it seem like we stole your idea, so that's why I am asking before more progress gets made on them.

in general you can do what you want using any original pokemon and fuse them. there is no "this person had the idea first and owns it now". there is a big poke fusion community out there. and many fuse the same species as another person already did. it is the same like any hybrid or inspired species made out of two or more RL animals. (as long pokemon tollerates fan art any pokemon species is a free good for everyone for characters and art) what you own is your unique design and the art not the idea itself. I think I was the first skunk bunny hybrid on FA, and everyone is free to make one as long you don't use my characters design. and there are a lot now.

tl;dr:
using the same two species to fuse and come up with an own design = fine.
using the same design tartii came up with or her artwork without asking = not fine.

Honestly using this design is also fine. This is Charizard with Salazzle colors/features. It's all Nintendo. Using the design is fair use. Selling it is not. This will comment will get deleted/torn apart because I'm going to say this, but Tartii is actually in the wrong here. This auction isn't strictly speaking legal.

I know you're trying to say that the specific way this is designed is owned by NummyNums, but sadly that doesn't much matter. Imagine if you made a mickey mouse plush, recolored it with donald duck colors, and tried to sell it. It doesn't make a difference how you did it, you're still going to get sued by Disney.

That said I really don't care. I really like Tartii's art and if people want to go along with this, that's great. Just posting this here if anyone's curious about how fair use works. Here's a helpful link as well.

I have to say I agree, and I had to come and see whether anyone else had pointed it out. Tartii's works are great, but selling designs that they took from Nintendo and mashed together, I don't think that's very cool.

This thread is full of salty kids that have neither design talent nor money to pay other people for the act of designing something. When does it stop being lemon-lime carbonated beverage and start being Sprite? Someone had to refine the idea into something tasty and desirable. That job ain't free.

I didnt even mean to start anything, I just asked a question then it sparked a debate, which i am not going to to touch, to each their own opinion and I respect that they have their own opinion

Ugh, I hate not having the funds to get this! A triple type combo like this is amazing to say the least. Salugia I think is technically a 4 element combo. Flying, psychic, poison and fire. Feel free to correct me if I'm wrong on that though lol. I'm tired and my brain does random things when tired XD
