I imagine Elex could well be entirely innocent and not having done anything to deserve this, merely being an innocent victim chosen because his captor had a fondness for Smeargles and thought he had a particularly attractive looking set of paws. Perhaps it's not the actual tickling that has Elex worried but his captor has just been staring at his feet like that for the last two hours and he's wishing they'd just get on with it, and they've not even gotten to the stage of considering which particular tools they would use.
Though thinking about it, a Smeargle's tail with the plumed tip would probably make a very effective tickling tool, even if not for the Smeargle's own soles and toes.
