There are still pirates on Earth, in Somalia. But many of them are just poor people who need money and stuff to help their families. I watched a documentary about that, a French person visited pirates and stuff in both Somalia and Nigeria to ask questions so that he could teach people back in Europe.

As for the second part - in terms of basic game mechanics, it's basically like Warhammer indeed - you build an army for a point limit, move figurines at distances with measure tape and roll dice for stuff like attack or defence rolls.
Differences appear in specific game rules, but if you know how to play the tabletop Warhammer, learning how to play Black Powder (and other Warlord Games's products) isn't troublesome. After all, those were created by Rick Priestley, a former Games Workshop worker.
