I can't understand the Szard ruler's thinking, he knew he was stealing the gem and he let him, but now he worries about other people finding it. Why did he not just kill the swordsman as simply as he killed this scapegoat thief?

Not to defend him too much but, He's not actually >worried< about people finding it as much as it reappearing in his own kingdom as he said. He seems happy with it being scattered to the winds in some other faraway kingdom.
