The day 1 of his trial Xoda had heard both sides of the argument.
Both prosecuting and defense councils made their case to either go ahead or dismiss the court proceedings.
Day 2 of Xoda's trial had arrived his charges were as followed:
1. Protesting during the Equestria Games
2. Harrassment of other ponies
3. Causing a disturbance and
4. Discussing the equestria games in a negative way.
Two guards came to the cell door and unlocked it.
"Xoda....it's time."
Xoda had been sleeping on the thin straw that was provided, it had been the worst 2 nights of sleep ever however it looked like it could be his home for sometime if found guilty.
As he went to the cell door, one of the guard's went up the stairs followed by Xoda followed by the second guard as they headed into a room. Inside was a piece of dark glass, 12 jury ponies stood the other side (however you can see only 4 here). Guards stood either side of Princess Cadance as she would preside over the case, guards stood either side of Xoda too.
The jury ponies had been viewing the case yesterday after Xoda had entered his not guilty plea, and the morning of the trial before they had made their decision, the jury was independent of Princess Cadance and she would decide the punishment and sentence if guilty.
"ALL RISE!" called out a crystal pony and everypony stood up as Princess Cadance entered the room, everyone bowed before her as she stood proudly.
"Filly or gentlecolt forepony of the jury, please stand." called out the crystal pony.
One pony of the jury stood up.
The crystal pony guard then talked to the forepony
"To my first question, answer yes or no."
"Has the jury reached a verdict on all charges of which at least 10 of you agreed?" Asked the trial guard.
"Yes" said the pony juror.
To my next question, answer only guilty or not guilty.
"On charge 1 the charge of Protesting during the Equestria Games, Do you find the defendant Xoda guilty or not guilty?"
"Not Guilty" said the juror.
"You find Not Guilty" responded the guard.
"On charge 2 the charge of Harrassment of other ponies, Do you find the defendant Xoda guilty or not guilty?"
"Not Guilty" said the juror.
"You find Not Guilty" responded the guard.
"On charge 3 the charge of Causing a disturbance, Do you find the defendant Xoda guilty or not guilty?"
"Guilty" said the juror.
The viewing gallery of ponies looked on gasped in shock.
"You find the defendent Guilty of causing a disturbance. Is that a unanimous verdict or by majority?" responded the guard.
"By Majority" said the juror.
"How many agreed? how many dissent?" the guard responded.
"10 of us agreed, 2 dissent." said the juror.
"You find Xoda guilty by majority of 10 to 2." the guard replied.
"We do." said the Pony juror.
"Finally charge 4 the charge of Discussing the Equestria Games in a negative way"
"Do you find the defendant Xoda guilty or not guilty? Asked the guard.
"Not Guilty" said the juror.
"You find Not Guilty" responded the guard. "Thank you, you may sit down."
Princess Cadance had to think carefully now but as she did so she asked council on Xoda's side if he had any closing statement to make.
"Yes, Princess Cadance" and just as he stood up Xoda interrupted the proceedings
"Please you can't put me back in the cell, I was standing up for what I believe in."
Princess Cadance then interrupted the pony telling him to keep quiet while council speaks on his behalf. Xoda sat back down.
"Your honor, Xoda is a very good pony, he is no way a danger to any other pony, when he was young colt living in the Griffish Isles his country won the right to host the Equestria Games, he want to become part of the support team, he tried but sadly failed to make the grade, he then tried to promote the games as it was happening in his country, when that failed he tried to show of places where events could be held, therefore every part of the Griffish Isles would be able to attend local events without needing to travel great distances."
"When that failed as well Xoda admitted defeat, he didn't watch the games feeling uninspired almost helpless that he wasn't listened too, the games organisers had said before and during the games there would be a big legacy that meant every part if the Griffish Isles would be touched and the legacy would benefit everyone. The organisers had promised sports for all equines whether you were an allicorn, earth pony, unicorn, griffin or other species that you could participate in your favourite sport. But sadly while the sport moments of the games were memorable, the events after fell way short. The city of Bristail couldn't fund the activities and found itself in millions of bits in debt, only certain areas found themselves getting any sport funding for these activities at all, the stadium had fallen into disrepair because what had been planned to make it a place for the community to come together never happened with the funding not being recieved from organisers meaning it became a white elephant on the community, unused and unloved, business were shutting down their shops because no-pony could afford to visit or buy anything, finally the legacy of a better Bristail after the games never materialised and the ponies of Bristail and other parts of the Griffish Isles are still not recovered from the games, I personally believe Xoda was doing what he thought was right and was sending a warning out about ponies to not support these games because of what they did back home when he was a colt. Does Xoda deserve further such punishment or should he get the compassion and leniency of the court?, thank you your honor."
Princess Cadance looked at council as he finished his statement.
"Thank you for that statement council. Will the defendent rise."
"Xoda, you have been given not guilty on 3 of the 4 charges, in response to the not guilty verdicts by the jury, thoses charges I'm acquitting you of." Xoda took a breath of relief as Princess Cadance continued.
"However.... you have been found guilty on causing a disturbance and while I do take council's statement very seriously and the fact this is your first time offence, you are still guilty of that crime, I therefore sentence you to 6 months in prison."
"GASPS" could be heard in the courtroom from the public gallery, everypony was shocked. 6 months for having an opinion.
"6 MONTHS!?" said one shocked unicorn
"Don't worry, he will appeal against it, its too harsh." said another pony.
"WILL THE COURT COME TO ORDER!" called out a crystal guard.
"YOU CAN'T INPRISON XODA LIKE THAT, THAT'S WRONG!" shouted one passionate pony from the public gallery.
"BE QUIET!!" shouted a pony guard who was determined to have order restored.
"ARE YOU DEAF OR SOMETHING, XODA IS INNOCENT!!"
The majority of the viewing gallery protested and chanted.
"WE ARE BRISTAIL!"
"WE ARE BRISTAIL!"
"WE ARE BRISTAIL!"
"WE ARE BRISTAIL!"
Xoda just looked shocked at everyone who was fighting his side. This was passion and it was clear the ponies in the viewing gallery wern't too happy about what was going on.
Finally Princess Cadance had had enough.
"IF I MAY PROCEED PLEASE!" she shouted to everyone in the court.
"Xoda I sentence you to 6 months in prison suspended for 30 days, do you understand what that means?"
The mood changed from being one of anger to absolute joy.
"We've won....WE'VE WON!" Shouted one of the ponies from the viewing gallery as ponies in the viewing gallery clapped, the friend of Xoda's left the viewing gallery to go over and hug Xoda.
That was it, Princess Cadance had past her sentence and as she left Xoda was going to go home, finally a free pony.
