TERMS OF SERVICE FOR THEPINKFURY
IF YOU DO NOT AGREE TO ANY PART OF THIS TOS, PLEASE DO NOT TAKE COMMISSION FROM ME.
1. ALL CHARACTERS ARE 18+ YEARS OLD.
2. ALL PRICES ARE IN USD.
3. I can use any characters I design or art I render/draw for promotional art and/or fanart of characters.
4. Any kind of charge back will result in a blacklisting and a ban as well as reporting your info(username and such) to servers/YCH/artists.
5. Reselling adopts sold made by me is allowed, but you cannot sell for a higher price than which you bought, unless additional art is added. (please contact me if you plan on reselling).
6. Any adopts given for free or won from giveaways CANNOT be sold, only given away for free, regardless of original artist of the design.
7. Joint ownership of designs is allowed however, to resell, change design(after approval), or givewaway, everyone in ownership must agree.
8. No real people! Only OC's or fandom characters.
9. Failing to follow the ToS will result in a complete blacklist to any of my services.
10. Commissions are for personal use only. Artwork may be used as profile pictures/banners, but may not be used for profit. Please contact me via email for commercial works; there will be additional fees for commercial rights.
11. I own all rights to the work. Putting my work into any A/I engine is prohibited.
12. I am allowed to post on my social media unless requested otherwise. I am allowed to include the artwork in my portfolio.
13. Fanart commissions consisting of characters from any game/series/etc may be used by me to produce physical prints and other merchandise for me as I see fit.
14. Listed prices are the base price. Please understand that the price may increase depending on additional details and the complexity of the commission.
15. I have every right to decline a commission if I feel that my skill level may not meet your request or if the request falls under subjects I will not do.
16. Please wait patiently for your commission to be finished. You are welcome to ask for updates if there hasn't been one in a while! I normally provide updates at the rough sketch, flat colors, and final check phases.
17. Reposting and sharing the artwork is OK, but please give credit.
18. Payment is via PayPal only. An invoice will be sent by me. A deposit of at least 50% (NON-REFUNDABLE) must be paid before I start working. Once the sketch is approved, the remaining balance must be paid in full before I continue working and finish up your request.
19. Payment plans is acceptable. Please contact me to discuss.
20. For regular customer there is no deposit and can be paid after the whole job is done. Regular customer has more than 3 done commission from me.
21. I have every right to decline a commission if I feel that my skill level may not meet your request or if the request falls under subjects I will not do.
22. Please provide visual references. Non-visual references may result in additional fees or be declined. Providing full references helps me guarantee that I can better fulfill your request and avoid unnecessary mistakes in the process.
23. If for reasons you need to cancel your commission after paying the 50% deposit but BEFORE the sketch has been approved, I won’t give a refund (please, keep that in mind).
24. Upon starting, I will send progress images of the sketch (and flat color if necessary) for your review to approve or make revisions before I proceed to finish the artwork.
25. Once I am finished, I will send one final check for your review. Three (3) minor revisions may be requested. More than three (3) will incur an additional fee that must be paid in full before I proceed to make adjustments.
26. Once the finalized artwork is accepted, I will email you full res .png files of the work and watermarked .jpegs for social media posting. No physical product will be delivered.
27. By commissioning me, this means you have properly read, understand, and AGREE to the terms listed above and on the invoice.
28. Please be kind. Any aggressive, rude, or inappropriate behavior against me during the process will result in me canceling the commission. You will be refunded for the commission upon cancellation by me, but I will be keeping 50% of the total payment.
29. Leave a testimonial after working with me! It is not necessary, but It is really important. Thanks!
