Kyogre USES AQUA TAIL!
This delightful Legendary is playing with his food! Using Aqua Tail, Kyogre aims to heavily disorient this Empoleon so that by the time it lands in it's jaws like a piece of tossed popcorn, it'll be too late to understand what's going on. Hopefully Kyogre minds it's tail though. Soaking wet it is bound to slide down easy. But even if not I'm sure those teeth will do the job.
