Arizona- if both are 65 or older, or one is unable to reproduce.

I say strip the word marriage of all legal standing whatsoever. Go to a judge to get hitched? Should be called civil union, regardless of whether or not the couple's gay or straight. Marriage should just be the word people use to describe the ceremony and the religious binding, which would now have no legal sway. I think if we did that, we might actually see progress on this issue.

Instead of marriage contracts, they would all be called civil union contracts, leaving the term marriage as something that encompasses both the civil union contract and the ceremony/reception rigmarole. If this were the case, there would be no precedent barring gay couples from getting a civil union license, and you definitely couldn't legally bar a gay couple from holding a wedding in a religious congregation that accepted them, or just holding a ceremony under no religious jurisdiction whatsoever. My proposal strips the religious right of their primary talking point, the definition of marriage, by changing the legal definition of marriage.

Besides, calling the legal proceedings marriages is a potential violation of the establishment clause, as marriage is historically a religious institution. I know that's not ironclad, but that's how it's been for a long time.
