A jury originally awarded the Harris family $150,000. Later, the award was reduced to $75,000 when it was decided Harris should share at least half of the blame.

I love how one case becomes the norm. There's so much that could be said... like how LEGAL is it to have a deadly trap set up ANYWHERE? I mean c'mon. I've heard the same bullshit story about someone "falling through a skylight, breaking-in". They're scare stories invented to make us all fear the Democrats and how they want to take our guns and ability to defend ourselves.

in the uk pretty recently a burgluar broke into a house and the guy living their killed the man with a shovel i think it was. anyway it did go to court but was deemed that it was the burgulars fault so yay yay common sense prevailed

Here in the states she'd definitely be sued. Charges would most likely be pressed and this would snow ball into a huge thing. Even if it is what half the restaurant patrons wished they could have done. XD

I think it would have been better for her to discuss it with the parent, instead of engaging the kid at all. Though the comic does make a good point, two points to every story, and it's not good to overreact.

yes the child does need to be resposable for their actions, BUT it's the parents job to punish their children for being little shits. If not then full blame goes to the parent for NOT raising their child properly.

A suit might've been filed, but unless said person was able to pay off a doctor or someone to testify that physical harm came to the child... it wouldn't be heard in a court.

The US legal system isn't as big-bad-wolfish as people make it out to be. We've had our fair share of odd-ball cases, but then again - you guys can file for Super Injunctions that ban people from talking about someone or something... that's something WE all feel is incredibly silly. :) http://www.telegraph.co.uk/news/886.....junctions.html

The thing I haven't seen posted about is what is more likely to happen: Gem could call the local social services and report said parent for failing to watch their kid. THAT happens far more regularly.

In America, it kind of goes 50 50. Sometimes they threaten to sue, and other times they just threaten to call the police if they see the other person near their kid. What's funny about the threat to sue is that in America, they usually just get caught up in the heat of the moment and completely forget to even get the other person's name or or anything XD. Then again, sometime the parents argue back and forth, and it eventually escalates into the parents actually fighting each other.

there is good news! sometimes an event like that can be so traumatising that the kid stops being such a dick and starts behaving like a real human being [or furre being as the case may be] if only out of fear that the person is going to come and hit them in the face again

Well, in America, I think the same thing would have happened. I ought to know. I did something very similar once to this annoying kid. The only difference was that the kid laughed it off. I still got my head bitten off and I didn't even get the chance to state my side of the story.

Although, I once also mildly and politely mentioned to one parent who came in to a restaurant to teach the (dozen or so) kids she was watching over that when a trash can is full, Don't keep piling up (This includes Food, trash, and none disposable trays) until it's three feet above the mouth of the can. Not only did I get my head taken off by her, but I had to clean up the mess afterwords.
