It's likely an Eastern Yellow jacket hun. If you can get a better look at it's face and see small black dots around it's eye it may be a German wasp.
As I said before, these are very helpful insects so I would advise against killing them if you can help it. Luckily, they only have a season long cycle, so if you can help it, try to steer clear of that area if you can. They'll have moved on by summer's end.

You seem to understand that there are many breeds of one subset of a species, but don't seem to grasp the concept of multiple species of wasps and bees. Not all yellow jackets are created equal. This is likely a Eastern Yellow Jacket, which is common in the Virginia area.
Unlike the German Wasp, which was introduced to north America, and makes paper nests in trees,
Or the Common wasp, which does not share this type of insect's markings,
Can't be the Tree Wasp, because it dose not exist in this country.
