Carter was a South African photojournalist who started out work as a sports photographer in the 1980s before him and a small gang of photojournalists (known collectively as the 'Bang Bang Club') documented the political strife and violence going on in various parts of South Africa. Sadly, the things he witnessed had a traumatic effect on him and following the loss of one of his close friends who was also in the Bang Bang Club, Carter took his own life in 1994 just months after taking his above-mentioned picture.
In 1996 Kevin Carter was immortalised in the song that bears his name by the Manic Street Preachers, which went top ten in the UK. Some of the song's lyrics are included in this picture for effect.

Yep, it's real. The photographer saw the guy (Ki Suk Han) get pushed on the tracks by a mentally ill vagrant who had since fled, but instead of trying to help him up off the track he took that photo instead. (He later claimed he was trying to use his camera's flash to alert the driver, in reality all he did was blind the driver so he couldn't see the Han on the track.)
Ki died instantly. Russi wasn't arrested for anything since he didn't push the guy and moral obligations are not set in law. *shrug*

In New York, perhaps. In Ohio we have what's known as a "Good Samaritan Law": people can be held criminally liable if harm comes to someone that they refused to help.

Good Samaritan Law is code protecting people from legal repercussions upon them delivering aid to a casualty, not mandating aid be delivered...
I think what you mean is Duty to Rescue law, which mandates reasonable attempts to deliver aid to a casualty are made upon discovery of said casualty. And in the US (and my country as well) at a federal level at least, it's not a legal requirement.
