TERMS OF SERVICE
PRICES/QUOTES:
I charge on an hourly basis. I work at a cost of $50/hour. Additional costs may be accrued based on further touch up requests.
Quoted prices are good for 30 days from date of quote, unless otherwise stated.
PAYMENT:
Payment is required upon time of booking for the shoot. Payment for any additional services (prints, albums etc.) is due before work will initiate on these items. All orders must be paid in full prior to shipping. All prices are in CAD.
Payments are accepted by Paypal, E-transfers. Cash is accepted in person only.

QUEUE SYSTEM:
All work is based on a booking system. Photoshoots will be booked at a time convenient for both the photograher and customer. If a customer must rebook for whatever reason, a minimum of 72 hours is required otherwise you will forfeit your payment. Rush orders are accepted at the photographer's discretion, additional rush charges may apply.
FREIGHT TERMS:
All shipments are made via Canada Post unless otherwise requested by the commissioner.Shipping is NOT included in the price of the photoshoot unless previously agreed upon in writing. Shipping will be calculated once the order is completed. Shipping quotes can be provided beforecompletion, but these quotes are subject to change.
The customer is responsible for all duty fees, customs, brokerage, and taxes over and above the cost of shipping. For legal purposes, we refuse to ship our products as "GIFTS".
Local pickup is also avaliable.
CANCELLING/ORDERING COMMISSIONS:
Customers are responsible for payment of all expenses incurred up to the time of cancellation ( ex. model booking, special prop booking. If notice of cancellation is given less than two (2) full business days before the shoot date, Customer will be charged the full fee.
If the photographer needs to cancel for any reason, the customer will have the option of rebooking or a refund in full.
Changes may NOT be made once process of work has begun on an order. Once a photo hasbeen touched up and approved, no further changes will be made. If you require a further changes to be made, the photographer holds all rights to charge what he sees fit based on whatchanges are required.
SHOOTS:
Keith Coughlin Photography agrees in full that the equipment for the aforementioned Shoot will be set up ahead of the time before the shoot. The Customer will not be charged for the initial moving of such equipment or the fine tuning of the camera.
Keith Coughlin Photography encourages Customers to bring items such as props to the shoot, however, they are subject to the liability clause.
In any event of a technical error before or during the shoot, the Photographer agrees not to charge the Customer for any amount of time during the technical error.
RE-SHOOTS:
Customers will be charged for a full price session and any expenses for any re-shoot required by the customer. For any re shoot required because of an act of God, fault of a third party, or technical error, the Photographer will not charge any additional fee.
RELEASE FORMS:
Photographer is not responsible for obtaining model, property, or other releases in connection with any of the photographs licensed herein unless specifically stated herein.
In the event that the picture issued or reproduced by or with the authority of the Customer, the Customer agrees to indemnify Keith Coughlin Photography against any loss or damage, proceeding or costs where such rights, releases or consents have not been obtained.
REPRODUCTION OF PHOTOGRAPHS:
Reproduction rights are not issued exclusively to the Client except when specified on the invoice.
When issued, reproduction rights granted are personal to the Customer and may not be assigned, nor may any picture submitted to the Customer be loaned or transferred to third parties. The Customer may use the photos in any online gallery, however, the image must remain watermarked and an excerpt under the photo must state that the photograph came from KEITH COUGHLIN PHOTOGRAPHY©
Customers agree that they will not make or permit any alterations, additions, or subtractions in respect of the photographs, including without limitation any digitalization or synthesizing of the photographs, alone or with any other material, by use of computer or other electronic means or any other method or means now or hereafter known.
Keith Coughlin Photography reserves the right to use any and all photographs in a manner for commercial and advertising purposes. Customers may contact the photographer if they wish to negotiate these terms for any reason.
COPYRIGHT PROTECTION/ MEDIA USAGE:
Until Keith Coughlin Photography has invoiced the reproduction fee neither party is committed to grant or acquire any reproduction rights in any picture. After a fee has been agreed and an invoice issued there is a firm and binding contract whereby Keith Coughlin Photography is committed to grant reproduction rights and the Client to acquire them. If after such invoicing but before payment the Client requests cancellation of the reproduction rights Keith Coughlin Photography may in its discretion cancel subject to the Client paying a cancellation fee.
For Editorial use, credit line in the form: ©Keith Coughlin, in type no smaller than that of related text must appear adjacent to or within the photograph(s) or the media fee is tripled; Client acknowledges that such a triple fee is fair and reasonable for photographer's loss of recognition and lack of copyright protection resulting from lack of, or improper, copyright notice/credit line.
Publication of any photos in a free in-house magazine is not normally available to the public;If you wish to obtain rights, please contact the Photographer by using the "CONTACT US" page.
DEFAULT/ NON PAYMENT:
In the event of non-payment or other breach of this Agreement by Customer, Customer shall pay all of Photographer's costs and expenses incurred in connection with enforcement of the terms of this agreement, including Photographer's reasonable attorney's fees.
**ALLERGY WARNING!**
The equipment used is in close proximity of a dog. Although the dog is not allowed in or near any of the equipment, inevitably the hair may still end up with it.. If you still wish to have a shoot,please contact the photographer. Other arrangements can be made for either an outside shoot,or perhaps a shoot without a background.
LIABILITY CLAUSE:
Under no circumstance shall Keith Coughlin Photography be held liable for personal or property damage, including incidental, special or consequential damages, expenses, costs or other liabilities, arising out of, or related to, the services provided by Keith Coughlin Photography. By reading this Terms of Service and signing or agreeing to a photo shoot, you agree to release and not hold Keith Coughlin Photography accountable for any loss, liability, or damage that you or the owner or lessee may suffer. (This includes any items brought by the customer to the shoot)
While Keith Coughlin Photography takes all reasonable care in the performance of this agreement generally, it shall not be liable for any loss or damage suffered by the Customer of by any third party arising from use or reproduction of any picture or its caption.
The Client agrees to indemnify Keith Coughlin Photography in respect of any claims or damages or any costs arising in any manner from the reproduction without proper reproduction rights of any picture supplied to the Customer of Keith Coughlin Photography.
Acceptance of Terms and Conditions:
All contracts and transactions between the Photographer and the Client whether made orally or in writing are subject to these terms and conditions which shall be deemed to be incorporated into any contract between the Photographer and all or any of its Clients
