A friend needs legal help/advice with divorce
6 years ago
This is her message:
I am a single mom in need of help. I am trying to get a divorce from an abusive, lying, deadbeat husband and keep my son as far away from him as possible. I have a part time job but the cost of the divorce is out of my budget as I am paying for my sons needs almost entirely on my own. I'm not asking for a fortune. I just need help to get myself out of a bad situation. I am not a member of FA, but I am friends with the artist sending this note. I understand wholeheartedly if nothing can be done for me. Thank you for your time and consideration.

This girl has been through so much, and I wish I could do so much more to help her but I'm stuck. After my exams are over I will be doing donation drawings to try and help her too, so (Aprilish) please keep an eye out for that too. Any help or advice is greatly appreciated. I want her to be able to be free finally <3 ;_;
Edit: She's got an interview for a second job (she really wants to get out of this situation, I'm amazed at her willpower), and is going to spend next week trying to find a lawyer that will respond to her emails/calls (they never get back to her). I've suggested just asking the cost of a consultation fee, so that she can get information from them. The divorce isn't as much the issue as the custody battle for the son, but she has so much proof against the father that it should be a quick case hopefully

I would think the lawyer should be able to help her, also have her look for ones that do pro bono cases for the abused and the helpless (children in situations like these). A lot of times they work with them. She can also get a restraining order if she has another place to go for the time being. And mothers always have primary custody unless proven unfit by a judge ((jobless, drugs, children not seeming to be taken care of, etc.)) Which from her story isnt the case at all. And also depending on state there are laws that could work well in her favor too. I dont know a lot but I hope this helps some.

OP
She has a restraining order against him just last month, in both her and her son's name (I posted it in the dropbox link as proof).

I know it largely depends on where you live, but I was able to seek a divorce at no cost through Legal Aid here in the US due to abuse and neglect. I simply had to prove that there was abuse going on, and my police report and restraining order were enough. I was able to seek these sources from women's homes and services that specialize in taking in or helping abused women. That would be one of the first steps, or maybe even contacting the police department themselves to see what kinds of things are available. However, I must note that my opposing party had no lawyer. If they get one, you might be in for a much longer ride than intended and it might not turn out the way you hope. My suggestion is on top of seeking sources is to find a good lawyer that will help you or at least offer advice- at least if you can afford it.

This! Look for a county organization/agency that helps advocate for domestic violence survivors. I have gone through this as well so this is near and dear to me. Legal aid should be provided through the court, she shouldnt have to pay a penny out of pocket. Certain agencies also have extra programs that can help with rehabilitation, like rental assistance, food stamp application assistance as well as a bunch of other things that are incredibly helpful. I wish her the best of luck, and please let her know no matter how badly she feels, that it's not her fault and things will get better, she can do this!
