This page is the Terms of Service for Azikira's commissions and merchandise.
These terms of service apply to /all/ pre-existing art, as well as all current art, future art and merchandise created by Azikira.
1. You CANNOT use art you commission from Azikira for profit, including selling it digitally or physically. You CAN however request a merchandise commission with specified limitations (See Term 4).
2. You CANNOT use art made by Azikira to make into or sell as NFTs, or as a part of ANY current or future Blockchain related technology. If you attempt to sell NFTs of any art you've commissioned from us, legal action will be taken against you. The same applies to all of Azikira's art and designs.
3. You CAN post any art you commission from Azikira freely on any website, as long as we are credited as the artist, and it's not defamatory or behind a paywall (See Term 1). While not mandatory, it would be highly appreciated if you do post any artwork you commission from us, that you link to one of our accounts, such as https://twitter.com/Azikira.
4. If you wish to commission Azikira to make a design that you intend to sell on merchandise, your intent to sell must be disclosed before we accept payment. We are willing to work with a commissioner to design merchandise on a case-by-case basis. This exception does NOT apply to NFTs, and you still CANNOT make or sell any artwork we've made as an NFT, EVER.
5. You DO NOT own the rights to any designs created by Azikira for sale on any of her stores or platforms of choice, including Etsy, Spreadshirt, Ko-Fi, and all others that are applicable, even if you purchase a physical item with that design.
6. Azikira does not own the rights to any trademarked or copyrighted characters or imagery, and any depiction of such characters is Parody or Fan Art. All rights of those characters belong to their copyright holders.
7. Payment is collected at the time you commission Azikira. Payments shall be done via Paypal. If no work has been done in 1 month from the commission date for art, or 3 months for physical merchandise, you may request a refund. If the commission has been partially completed, you can only request a partial prorated refund depending on the level of completion. There are no refunds on finished pieces. Any pieces cancelled by Azikira will be refunded, either fully or partially, depending on the level of completion.
8. Azikira will NOT accept Cryptocurrencies as payment. Not now, not ever.
9. You are allowed 2 edits on your commission for free. Any edits after this point will cost a small fee (relative to the cost of the piece). If Azikira misses something significant from your reference sheet, or uses a wrong color, those edits to make the piece accurate will be free (within reason).
10. Azikira holds the right to refuse service to anyone, for any reason. We have the right to look at your accounts and see if you're a decent person, and will not do business with abusers of people or animals. If for any reason we do business with someone like that, it's likely because we did not know about it! Please, feel free to reach out and inform us! This does not, however, give you the right to harass us or anyone we work with because you don't like them. Use common sense here.
11. Azikira's Terms of Service may be updated over time, and those terms will apply to all pieces, including past pieces. These terms of service are intended to legally protect ourselves, as well as protect our commissioners, and protect Earth's environment as much as can be done.
12. By commissioning Azikira, you are agreeing to ALL terms of service mentioned above. Even if you did not read the Terms of Service, by commissioning us you are /still/ agreeing to them and legally bound to these terms of service, and any attempt to break terms of service conditions will be met with legal action.
If you have any comments or concerns, feel free to reach out to us. We're pretty reasonable people and usually willing to talk with you about any fears or concerns you have. Just use common courtesy please.
