Drawing Commission TOS

By commissioning me in any way, you are agreeing to the terms of service below.
[I. GENERAL]
★ I reserve the right to not accept your commission order without any reason or explanation.
★ I have the right to alter my Terms of Service at any time. New rules will not apply retroactively and won't influence orders started on older terms.
★ Please be respectful and clear about your idea.
★ Provide good references.
★ Try to avoid wall texts unless is necessary or the conversation allows it (I love to hear about your character's story and stuff but sometimes is hard to understand what you want if you jump down about a lot of topics, so please be clear about what you want for the commission and then we can talk about extra things).
★ I can cancel the commission request at any, in this cases your money/points will be returned if applies.
★ Follow the rules provided in the commission journal/sheet.
★ Any ill behavior will not be tolerated and your commission will be canceled if it occurs.
[II. PAYMENT AND REFUNDS]
★ All commissions must all be paid in full upfront.
★ The currency accepted is USD (PayPal).
★ The price depends of the commission and can change for each case.
★ I do not accept holds.
★ Payment must be done in the next 48 hours from the moment I send the invoice. Invoices past the due date will be cancelled, also cancelling the commission associated to it.
★ Payments without prior invoice won't be accepted. Please include your paypal address so invoice can be prepared and sent.
★ I am covering all possible fees and transfer-related expenses.
★ Refunds can be requested at any time.
★ Full refunds are issued only before the start of work on particular order.
★ You have no right to make cancellation and refund if commission is being cancelled during actual creation process.
If you file a chargeback against me, your right to everything I have ever made for you will be retracted and I have the right to sell the copyrighted artwork to new buyers.
★ You will forbidden and blacklisted to ever commission me.
★ Your name will be publicly posted everywhere I want to for others to watch out for.
★ I also have every right to file a complaint and I have all the right to the money you have given me.
[III. PROCESS, REVISIONS, DEADLINES]
★ WIPs will be send when I make enough progress or when the customer asks for it, I'm always communicating with my clients and sending WIPs
★ Each commission type will receive sketch stage for approval and right to revision. After this stage only minor changes can be done for the commission so ask for anything you need on the sketch stage while we are working on it! If you want to do a major change on the commission, this will come with an extra feed depending on the complexity
★ Final edits and adjustments are always welcome, but not included in initial quote. They may be charged depending on complexity.
★ The time for your commission to be completed can be up to a month, depending on many factors such as: health, order of commissions, complexity, work, school or family/personal issues. Note that I had never take that long to complete a commission but if anything happens you will be notified asap
[IV. COPYRIGHT AND USAGE POLICY]
★ I as an artist retain all rights to created artwork. I reserve right to repost, use and sell created art in digital or physical forms. Profits won't be shared
★ Clients may repost watermarked art at will as long as credit to an author is included and no profit is being made
★ I do not claim any rights to characters and other intellectual properties used in process of creation
★ Every client has possibility to buy full rights to commissioned artwork. Details will be discussed individually
The commissioner are allowed to;
★ Use the copyrighted artwork for personal use only unless agreed otherwise. (Except in cryptocurrency and NFT-related transactions)
★ Print the art, and claim the right of their character(s) but not the drawing itself.
★ Use the art to promote themselves with proper credit given to the artist.
[V. CUSTOMER SATISFACTION]
★ After a commission is finished, only small changes are allowed to be made. Such as small colouring/marking mistakes.
★ Any great changes will come with an extra charge. Such as an outfit change, outfit addition or subtraction, background change or anything that makes me have to redraw it completely.
★ If your reference was unclear to start with, then you are not allowed to do minor changes without a fee. Make sure to be clear in your order what you aim for.
